【摘要】：眾所周知,南海諸島是我國(guó)的南部海疆,我國(guó)人民發(fā)現(xiàn)南海諸島已將近二千年之久,南海諸島對(duì)我國(guó)具有不言而喻的重要的經(jīng)濟(jì)意義和戰(zhàn)略意義。然而,隨著20世紀(jì)60年代末70年代初探測(cè)到南中國(guó)海海底蘊(yùn)藏著豐富的油氣資源,南中國(guó)海的經(jīng)濟(jì)價(jià)值不斷提升。經(jīng)濟(jì)資源的豐富和戰(zhàn)略地位的重要,引起了一些南海周邊國(guó)家的強(qiáng)烈興趣。尤其是2009年1月28日,菲律賓參議院通過(guò)2699號(hào)法案即“菲律賓群島領(lǐng)�；�(xiàn)議案”,將南沙群島中的部分島嶼和黃巖島劃為了菲律賓領(lǐng)土,嚴(yán)重的影響了中國(guó)與菲律賓兩國(guó)關(guān)系的健康發(fā)展。 本文分四部門(mén)來(lái)論述中國(guó)與菲律賓南海諸島的爭(zhēng)端：第一部分是簡(jiǎn)要的概述中國(guó)與菲律賓南海諸島爭(zhēng)端的由來(lái)與現(xiàn)狀；第二部分是中國(guó)與菲律賓關(guān)于爭(zhēng)議的南海諸島主權(quán)歸屬的法律分析,通過(guò)對(duì)菲律賓關(guān)于南海諸島的主權(quán)主張不符合國(guó)際法的論證和中國(guó)對(duì)南海諸島擁有主權(quán)依據(jù)的分析,進(jìn)一步證明南海諸島是我國(guó)的領(lǐng)土。第三部分是概述中國(guó)在與菲律賓在南海諸島爭(zhēng)端上所面臨的困境,這部分將重點(diǎn)放在了我國(guó)所面臨的四個(gè)方面的困難：南海九段線(xiàn)的尷尬地位,我國(guó)海洋立法的落后,“擱置爭(zhēng)議,共同開(kāi)發(fā)”困境重重和我國(guó)利用法律手段解決南海問(wèn)題能力較差以及域外大國(guó)介入,使得南海問(wèn)題呈現(xiàn)復(fù)雜化趨勢(shì)。第四部分是突破中國(guó)與菲律賓南海諸島爭(zhēng)端所臨困境的對(duì)策,通過(guò)明確中國(guó)南海海洋權(quán)益的范圍；健全和完善我國(guó)海洋法律體系；利用法律手段,和平解決南海諸島的爭(zhēng)端問(wèn)題；以及堅(jiān)持我國(guó)主權(quán)立場(chǎng),積極應(yīng)對(duì)爭(zhēng)端的國(guó)際化趨勢(shì)的對(duì)策,促進(jìn)南海問(wèn)題的及時(shí)解決。
[Abstract]:As we all know, the South China Sea Islands are the southern sea frontier of our country. Our people have discovered the South China Sea Islands for nearly two thousand years, the South China Sea Islands have the self-evident important economic and strategic significance to our country. However, with the detection of abundant oil and gas resources in the seabed of the South China Sea in the late 1960s and early 1970s, the economic value of the South China Sea has been rising. The abundance of economic resources and the importance of strategic position have aroused the strong interest of some countries around the South China Sea. In particular, on 28 January 2009, the Philippine Senate passed Act 2699, the baseline Bill for the Territorial Sea of the Philippine Islands, which classifies some of the islands in the Spratly Islands and Huangyan Island as Philippine territory, This has seriously affected the healthy development of relations between China and the Philippines. This paper is divided into four parts to discuss the dispute between China and the South China Sea islands in the Philippines: the first part is a brief overview of the origin and status quo of the dispute between China and the Philippines South China Sea Islands; The second part is the legal analysis of the sovereignty of the disputed South China Sea islands between China and the Philippines, through the argument that the Philippines' claim on the South China Sea Islands is not in accordance with international law and the analysis of the basis of China's sovereignty over the South China Sea Islands. Further proof that the South China Sea islands are our territory. The third part is an overview of the difficulties that China and the Philippines face in the dispute over the South China Sea Islands. This part focuses on the four difficulties that China faces: the embarrassing position of the South China Sea Nine Duan Line, the backwardness of China's maritime legislation. The difficulties of "shelving disputes and developing jointly", the poor ability of China to solve the South China Sea problem by legal means and the intervention of foreign powers make the South China Sea issue more complicated. The fourth part is to break through the dilemma of the dispute between China and the Philippines in the South China Sea Islands dispute, through clear the scope of China's maritime rights and interests in the South China Sea; improve and improve our maritime legal system; use legal means, To resolve the dispute of the South China Sea Islands peacefully, and to adhere to the sovereignty position of our country, to actively deal with the internationalization trend of the dispute, and to promote the timely settlement of the South China Sea problem.
