【摘要】：國際軟法的產(chǎn)生與發(fā)展是當代國際社會發(fā)展的客觀要求,能彌補因政治博弈而缺乏國際條約和國際習慣的尷尬局面,國際軟法的廣泛應用是當代國際環(huán)境法發(fā)展過程中的必要階段。東盟區(qū)域自然環(huán)境的特殊性導致東盟國家必須開展環(huán)境合作,而政治結(jié)構(gòu)的特殊性使得東盟區(qū)域環(huán)境合作中涌現(xiàn)大量國際軟法。國際軟法有助于消除各國簽署國際條約的顧慮,推動東盟各國環(huán)境合作的逐步開展。因此,應當充分了解國際軟法的優(yōu)勢與局限,并客觀定位以促進東盟區(qū)域環(huán)境保護目標的順利實現(xiàn)。
[Abstract]:The emergence and development of international soft law is the objective requirement of the development of contemporary international society, and can make up for the embarrassing situation of the lack of international treaties and international customs due to political game. The extensive application of international soft law is an essential stage in the development of contemporary international environmental law. The particularity of the natural environment of ASEAN region leads to the need for ASEAN countries to carry out environmental cooperation, and the particularity of political structure makes the emergence of a large number of international soft laws in ASEAN regional environmental cooperation. International soft law helps to remove the concerns of countries signing international treaties and promote the gradual development of environmental cooperation among ASEAN countries. Therefore, the advantages and limitations of international soft law should be fully understood, and the objective orientation should be made to promote the smooth realization of the goal of environmental protection in ASEAN region.
