【摘要】：隨著國際商事貿易的發(fā)展,國際商事仲裁日益成為商事爭議最為普遍使用的解決手段,1958年簽署的《紐約公約》是這一領域的核心法律文件。由于仲裁協(xié)議本身的獨立性,故《紐約公約》雖然只是承認和執(zhí)行“仲裁裁決”,但對“仲裁協(xié)議效力”的認定及法律適用已成為該公約最為重要的基礎性內容。本文以國際商事仲裁協(xié)議效力和有效性理論為基礎,結合《紐約公約》對仲裁協(xié)議的規(guī)定和各締約國現(xiàn)行有關國際商事仲裁立法與實踐,從仲裁協(xié)議有效性認定的管轄權、異議提出時限、有效性認定的程序、如何認定仲裁協(xié)議的有效性等幾個方面入手,著重探討中國作為締約國在當前國際商事仲裁領域立法和實踐方面的不足,論述中國在新的國際商事交往環(huán)境中,應如何充分發(fā)揮仲裁高效、便捷的優(yōu)勢,通過尊重《紐約公約》精神,借鑒《聯(lián)合國國際商事仲裁示范法》和其他《紐約公約》締約國的先進仲裁立法理念,結合中國的實際,在放寬對仲裁協(xié)議有效要件的要求、擴大仲裁機構對仲裁協(xié)議效力認定的權力、統(tǒng)一仲裁協(xié)議效力異議提出時限的做法等方面為完善我國的國際商事仲裁立法提出建議。
[Abstract]:With the development of international commercial trade, international commercial arbitration has increasingly become the most widely used means of resolving commercial disputes. The New York Convention signed in 1958 is the core legal document in this field. Because of the independence of the arbitration agreement itself, although the New York Convention only recognizes and enforces the "arbitral award", the recognition of the validity of the arbitration agreement and the application of the law have become the most important basic content of the Convention. Based on the theory of validity and validity of international commercial arbitration agreement, combining the provisions of the New York Convention on arbitration agreement and the relevant international commercial arbitration legislation and practice in each Contracting State, this paper discusses the jurisdiction of the validity of the arbitration agreement. Starting with the time limit of objection, the procedure of validity determination, how to confirm the validity of arbitration agreement, and so on, this paper focuses on the deficiency of legislation and practice in the field of international commercial arbitration in China as a Contracting State. This paper discusses how China should give full play to the advantages of high efficiency and convenience of arbitration in the new environment of international commercial exchanges by respecting the spirit of the New York Convention. Drawing on the advanced arbitration legislation concepts of the United Nations Model Law on International Commercial Arbitration and other Contracting States of the New York Convention, and combining the reality of China, we are relaxing the requirements for the effective requirements of arbitration agreements, In order to perfect our country's international commercial arbitration legislation, we should expand the power of arbitration institution to confirm the validity of arbitration agreement and unify the method of raising time limit for the validity of arbitration agreement.
