【摘要】：基于發(fā)達國家和發(fā)展中國家各自的利益訴求,國際植物新品種保護呈現(xiàn)出復(fù)雜的發(fā)展格局。一方面,發(fā)達國家借TR IPS協(xié)議極力推行主要強化商業(yè)育種者利益的UPOV公約;另一方面,一些發(fā)展中國家受CBD理念的影響,正積極尋求一個UPOV公約框架之外的更適合本國農(nóng)業(yè)發(fā)展水平的植物新品種保護模式。面對新的國際形勢,我國應(yīng)立足國情,在適當汲取UPOV公約1991年文本精華的同時,借鑒其他發(fā)展中國家的經(jīng)驗引入CBD理念,不斷提高國內(nèi)育種企業(yè)的自主研發(fā)能力,構(gòu)建具有本國特色的植物新品種保護制度。
[Abstract]:Based on the interests of developed countries and developing countries, the international protection of new plant varieties presents a complex development pattern. On the one hand, developed countries use the tr IPS Agreement to vigorously promote the UPOV Convention, which mainly strengthens the interests of commercial breeders; on the other hand, some developing countries are influenced by the CBD concept. We are actively looking for a new plant variety protection model that is more suitable for the level of agricultural development of our country outside the framework of UPOV convention. In the face of the new international situation, China should base itself on the national conditions, draw on the essence of the 1991 text of the UPOV Convention and introduce the concept of CBD for reference from the experiences of other developing countries, so as to continuously improve the independent R & D capability of domestic breeding enterprises. To construct the protection system of new plant varieties with national characteristics.
