【摘要】：電子提單貨物信息的瞬間傳遞在破解紙質(zhì)提單危機(jī),解決物流的在線傳送,為國(guó)際貨物貿(mào)易帶來巨大變革同時(shí),電子提單載體的無形性及運(yùn)行模式的改變,對(duì)現(xiàn)行以提單紙質(zhì)介面為中心所創(chuàng)制的提單法律制度提出了新的挑戰(zhàn)。電子商務(wù)化浪潮下電子提單在我國(guó)航運(yùn)業(yè)的運(yùn)用前景,遂使電子提單制度構(gòu)建成為一項(xiàng)新的立法任務(wù)。本文以電子提單現(xiàn)有的國(guó)際立法為依據(jù),界定了電子提單法律性質(zhì),論證了電子提單制度構(gòu)建的立法原則,探索了電子提單的流通問題,提出通過創(chuàng)設(shè)新的法律概念"控制",作為對(duì)電子提單權(quán)利公示、轉(zhuǎn)讓進(jìn)行法律調(diào)整的重塑概念,旨在為我國(guó)電子提單制度的構(gòu)建提出一孔之見。
[Abstract]:The instant transmission of electronic bill of lading information is to solve the crisis of paper bill of lading, solve the online transmission of logistics, bring great changes to the international trade of goods, at the same time, the carrier of electronic bill of lading and the mode of operation change.This paper presents a new challenge to the current legal system of bill of lading, which is based on the paper interface of bill of lading.The prospect of the application of electronic bill of lading in China's shipping industry under the tide of electronic commerce makes the construction of electronic bill of lading a new legislative task.Based on the existing international legislation of electronic bill of lading, this paper defines the legal nature of electronic bill of lading, demonstrates the legislative principles of the construction of electronic bill of lading system, and probes into the circulation of electronic bill of lading.By creating a new legal concept "control", this paper puts forward the concept of remolding the legal adjustment of the right of electronic bill of lading to the public and transfer, in order to put forward some opinions for the construction of the system of electronic bill of lading in China.
