【摘要】：1994年在法國巴黎的外交大會上通過了《聯(lián)合國關于在發(fā)生嚴重干旱和(或)荒漠化的國家特別是在非洲防治荒漠化公約》。1994年10月,112個國家的代表齊聚巴黎,舉行了《聯(lián)合國防治荒漠化公約》的簽字儀式。公約成為防治荒漠化領域中第一部具有法律約束力的國際公約,完善了國際環(huán)境法律體系。公約條文共40條,由導言、總則、行動方案、科學和技術合作以及支持措施、機構、程序五個部分組成,并且包括了非洲地區(qū)、亞洲區(qū)域、拉丁美洲和加勒比區(qū)域、地中海北部區(qū)域、東歐和中歐區(qū)域五個執(zhí)行附件。 本文根據(jù)公約的結構及重點,著重對公約文本進行分析解讀,并揭示其優(yōu)點與不足,以期引起人們對《聯(lián)合國防治荒漠化公約》的重視,促進國際防治荒漠化工作在公約的指導與約束下進一步展開。全文由七部分組成。 第一部分闡述了公約產(chǎn)生的背景及其意義,在實踐與法律兩個層面,分述《聯(lián)合國防治荒漠化公約》的由來,并揭示其對國際防治荒漠化工作所起的重要作用以及在整個國際環(huán)境保護領域所具有的突出意義。 第二部分解析了《聯(lián)合國防治荒漠化公約》關于一般義務、受影響締約方義務以及發(fā)達國家締約方義務的有關規(guī)定,通過與相關公約的比較分析了《聯(lián)合國防治荒漠化公約》在權利義務規(guī)定方面的特點。 第三部分對《聯(lián)合國防治荒漠化公約》的行動方案進行了深入研讀,剖析行動方案的特點及所體現(xiàn)的國際環(huán)境法原則,并分析了相關各方的執(zhí)行情況,指出《聯(lián)合國防治荒漠化公約》的實踐價值與實現(xiàn)的關鍵所在。 第四部分詳細分析了《聯(lián)合國防治荒漠化公約》關于科技合作的規(guī)定,并追蹤各層面在科技開發(fā)與合作中的現(xiàn)實狀況,突出科技、知識在防治荒漠化工作中的重要地位。 第五部分研究了《聯(lián)合國防治荒漠化公約》的支持措施,特別對其資金來源及機制進行分析,解析《聯(lián)合國防治荒漠化公約》實現(xiàn)的關鍵影響因素。 第六部分系對前面各部分的總結歸納,對《聯(lián)合國防治荒漠化公約》的優(yōu)點與不足進行了整體性評析。 第七部分揭示了《聯(lián)合國防治荒漠化公約》對我國防治荒漠化工作以及相關法律制度建設的影響和對策。 《聯(lián)合國防治荒漠化公約》的出臺與在各地的執(zhí)行對于荒漠化的防治起到了重要的推動作用。防治荒漠化是我們保護環(huán)境,保護人類生存空間的重要內(nèi)容之一,21世紀是經(jīng)濟社會繼續(xù)發(fā)展的世紀,更是生態(tài)文明進步的世紀。防治荒漠化的發(fā)展,保護我們的生存環(huán)境是《聯(lián)合國防治荒漠化公約》締約國乃至世界所有國家的共同責任。本文通過梳理研究發(fā)現(xiàn),《聯(lián)合國防治荒漠化公約》已在國際環(huán)境保護法律制度中成為重要的組成部分,但世界對其的系統(tǒng)分析與關注還極其有限,大多處于部分關注或直接援引的狀態(tài),希望經(jīng)本文系統(tǒng)解讀能加強各界對《聯(lián)合國防治荒漠化公約》的關注,并帶動更多的環(huán)保人士參與荒漠化的防治工作,共建可持續(xù)發(fā)展的和諧家園。
[Abstract]:In 1994 the French Paris diplomatic conference by the United Nations on < in the event of a serious drought and desertification (or) countries especially in Africa convention to combat desertification >.1994 in October, representatives of 112 countries gathered in Paris, held a "United Nations Convention to combat desertification on the signing of the Convention has become international. According to the structure and focus of the Convention, the Convention text analysis and interpretation, and reveal its advantages and disadvantages, hoping to attract more attention to "the United Nations Convention to combat desertification >, promote the international desertification work to further expand in the guidance and restraint under the Convention. This thesis consists of seven parts.
The first part describes the background and significance of the Convention, in two aspects of practice and law, the origin of the "United Nations Convention to combat desertification >, and reveal its important role on the international anti desertification work and highlight the significance in the international environmental protection field.
The second part of the analysis of the "United Nations Convention to combat desertification > about general obligation, affected parties and the relevant provisions of the obligation of developed country Parties obligations, and through the comparative analysis of the relevant Convention" the United Nations Convention to combat desertification in terms of the characteristics of > rights and obligations.
The third part action plan on "the United Nations Convention to combat desertification > in-depth study, analyze the characteristics of the programme of action and the international environmental law principle, and analyzes the implementation of the relevant parties, pointed out that the" key practical value with the United Nations Convention to combat desertification > now.
The fourth part analyzes the provisions of the United Nations Convention against desertification in detail, and tracks the realities of all levels in technological development and cooperation, highlighting the importance of science and technology and knowledge in desertification control.
The fifth part studies the support measures of the United Nations Convention to combat desertification, especially the sources and mechanisms of its funding, and analyzes the key factors affecting the implementation of the United Nations Convention to combat desertification.
The sixth part summarizes the previous parts and evaluates the advantages and disadvantages of the United Nations Convention for the prevention and control of desertification.
The seventh part reveals the impact and Countermeasures of the United Nations Convention for the prevention and control of desertification on the work of combating desertification and the construction of relevant legal systems in China.
