【摘要】：海牙誘拐公約中規(guī)定了重大傷害危險(xiǎn)例外,當(dāng)存在這些情形時(shí)締約國(guó)就無義務(wù)返還被誘拐兒童。不過,美國(guó)法院在適用該例外時(shí)形成了"進(jìn)一步分析方法",要求存在重大傷害危險(xiǎn)情形時(shí)需做進(jìn)一步的審查,對(duì)兒童慣常居所地國(guó)是否存在有效的保護(hù)措施或者可行的替代方法加以審查,以最終斷定重大傷害危險(xiǎn)例外的適用。雖然這種分析方法似乎符合海牙誘拐公約的快速返還目的,但是,它并不符合公約的根本目標(biāo),與兒童最大利益原則之間也存在較大的差異,從而不利于兒童權(quán)利的保護(hù)。
[Abstract]:The Hague Convention on Abduction provides for exceptions to the risk of significant harm, in which case States parties are not obliged to return abducted children.However, in applying the exception, United States courts have developed a "further analytical approach" that requires further review when there is a risk of significant harm,Review of the existence of effective protection measures or viable alternatives in the country of habitual residence of the child, with a view to determining ultimately the application of the exception to the risk of significant harm.Although this method of analysis seems to be in line with the purpose of rapid return of the Hague Convention on Abduction, it is not in line with the fundamental objectives of the Convention and there is a significant difference between the principle of the best interests of the child and the principle of the best interests of the child, thus undermining the protection of the rights of the child.
