【摘要】： WTO的爭(zhēng)端解決機(jī)制被譽(yù)為是“WTO王冠上的明珠”，是一個(gè)具有較強(qiáng)司法性的體制。以法律手段保障裁決或建議的執(zhí)行是該機(jī)制被認(rèn)為具有強(qiáng)制性的關(guān)鍵所在，這主要體現(xiàn)在DSU的第22條關(guān)于貿(mào)易報(bào)復(fù)的規(guī)定上。DSU關(guān)于貿(mào)易報(bào)復(fù)的規(guī)定脫胎于GATT1947第23條，它針對(duì)后者的諸多缺陷進(jìn)行了改革，形成了一整套詳盡的貿(mào)易報(bào)復(fù)規(guī)則。但近十年的實(shí)踐表明該貿(mào)易報(bào)復(fù)規(guī)則尚存在一定的缺陷，因此有必要對(duì)其進(jìn)行完善。本文的主要目的就是翔實(shí)地介紹貿(mào)易報(bào)復(fù)在實(shí)踐當(dāng)中出現(xiàn)的一些問(wèn)題，使我們能夠有一個(gè)清楚的認(rèn)識(shí)，，以期能為我們的立法和實(shí)踐提供幫助。 本文核心內(nèi)容有四部分： 第一部分貿(mào)易報(bào)復(fù)機(jī)制沿革；主要介紹了GATT的貿(mào)易報(bào)復(fù)機(jī)制和WTO的貿(mào)易報(bào)復(fù)機(jī)制及其在GATT的貿(mào)易報(bào)復(fù)機(jī)制基礎(chǔ)之上所作的改革。 第二部分WTO貿(mào)易報(bào)復(fù)機(jī)制的理論基礎(chǔ)；主要從WTO貿(mào)易報(bào)復(fù)規(guī)則和WTO貿(mào)易報(bào)復(fù)的適用兩個(gè)角度來(lái)進(jìn)行理論上的探討。 第三部分WTO貿(mào)易報(bào)復(fù)機(jī)制的實(shí)施與完善；這是論文的重點(diǎn)，從交叉報(bào)復(fù)的實(shí)施及評(píng)價(jià)和授權(quán)報(bào)復(fù)的實(shí)施及其評(píng)價(jià)進(jìn)行研究。筆者在結(jié)合實(shí)踐的基礎(chǔ)上提出自己的一些想法及完善的建議。 第四部分我國(guó)對(duì)WTO貿(mào)易報(bào)復(fù)措施的利用；結(jié)合我國(guó)的實(shí)際情況，我國(guó)當(dāng)前對(duì)WTO貿(mào)易報(bào)復(fù)措施應(yīng)持的立場(chǎng)以及應(yīng)慎重適用WTO貿(mào)易報(bào)復(fù)措施。
[Abstract]:WTO ' s dispute settlement mechanism is known as the " pearl on the crown of WTO " , it is a system with stronger judicial nature . The enforcement of the decision or recommendation by legal means is the key to the mechanism , which is mainly embodied in article 22 of the United States and article 23 of GATT 1947 . The practice of the last decade has shown that the trade retaliation rules are still in some defects , so it is necessary to perfect it . The main purpose of this article is to provide a clear understanding of trade retaliation in practice , with a view to providing help for our legislation and practice .





The core contents of this paper are as follows :





The first part of the trade retaliation mechanism follows the leather ;
This paper mainly introduces the trade retaliation mechanism of GATT and the trade retaliation mechanism of WTO and its reform on the basis of GATT ' s trade retaliation mechanism .





The second part is the theoretical basis of the WTO trade retaliation mechanism ;
Mainly from the WTO trade retaliation rules and the WTO trade retaliation apply two angles to carry on the theoretical discussion .





The third part is the implementation and perfection of the WTO trade retaliation mechanism ;
This is the focus of the thesis , from the implementation of cross - retaliation and the implementation of the evaluation and authorization retaliation and its evaluation . The author puts forward some ideas and suggestions on the basis of combining practice .





The fourth part of China ' s use of WTO trade retaliation measures ;
In the light of the actual situation of China , China ' s current position on the WTO trade retaliation measures and the measures of retaliation for WTO trade should be carefully applied .
