【摘要】：中國(guó)紡織業(yè)具有悠久的歷史，在國(guó)民經(jīng)濟(jì)發(fā)展中發(fā)揮著不可取代的作用。作為優(yōu)勢(shì)明顯的產(chǎn)品，中國(guó)紡織品貿(mào)易在國(guó)際市場(chǎng)中與其他國(guó)家糾紛不斷。本文以國(guó)際紡織品法律體系的發(fā)展過程為線索，闡述了中國(guó)紡織品貿(mào)易在這些法律規(guī)制下的發(fā)展歷程，介紹了中國(guó)加入世界貿(mào)易組織過程中有關(guān)紡織品方面的承諾，形成了《中國(guó)加入WTO議定書》和《中國(guó)加入工作組報(bào)告書》兩份重要的法律文件。最后，以歐盟和美國(guó)為例介紹了中國(guó)與主要發(fā)達(dá)國(guó)家的紡織品貿(mào)易糾紛以及中國(guó)為了解決糾紛作出的努力。在新的國(guó)際貿(mào)易情勢(shì)下，針對(duì)中國(guó)紡織品本身存在的問題提出了法律方面的解決對(duì)策，并以法律對(duì)策為依托，從企業(yè)、政府等方面亦提出了應(yīng)對(duì)之法。
[Abstract]:Chinese textile industry has a long history and plays an irreplaceable role in the development of national economy.As a product with obvious advantages, China's textile trade is in constant dispute with other countries in the international market.Taking the development process of the international textile legal system as the clue, this paper expounds the development course of China's textile trade under these legal regulations, and introduces the commitments on textiles in the process of China's accession to the World Trade Organization.Two important legal documents were formed: China's accession to the WTO Protocol and the report of the working Group on China's accession.Finally, taking the European Union and the United States as an example, the paper introduces the textile trade disputes between China and the major developed countries and the efforts made by China to resolve the disputes.Under the new situation of international trade, the author puts forward the legal countermeasures against the problems existing in China's textile industry, and puts forward the countermeasures from the aspects of enterprises and governments, depending on the legal countermeasures.
