兩岸海上貨物運(yùn)輸承運(yùn)人責(zé)任制度的比較研究

【摘要】:我國(guó)海峽兩岸海商法制定過程均有采用《海牙規(guī)則》等國(guó)際公約的相關(guān)規(guī)定。由于各自發(fā)展的歷史、背景并不一致,臺(tái)灣地區(qū)的《臺(tái)灣海商法》淵源于大陸法系又深受美國(guó)海上貨物運(yùn)輸法的影響。我國(guó)的《海商法》主要移植三大國(guó)際公約。承運(yùn)人責(zé)任制度是海商法的基石和中心,決定著海上貨物運(yùn)輸法的基本特征與價(jià)值取向,以此為研究對(duì)象,比較海峽兩岸各自的異同,將為完善我國(guó)大陸海商法的承運(yùn)人制度,為完全實(shí)行兩岸三通以及"一國(guó)兩制"法律制度的實(shí)施提供理論支撐和可資借鑒的經(jīng)驗(yàn)。
[Abstract]:The process of making maritime law on both sides of the Taiwan Strait has adopted the relevant provisions of the Hague rules and other international conventions.Due to the history of their respective development and different backgrounds, the Taiwan Maritime Law in Taiwan originated from the continental law system and was deeply influenced by the United States Law on the Carriage of goods by Sea.China's Maritime Law mainly transplanted three major international conventions.Carrier liability system is the cornerstone and center of maritime law, which determines the basic characteristics and value orientation of the law of carriage of goods by sea. Taking this as the object of study and comparing the similarities and differences between the two sides of the Taiwan Strait, it will be necessary to perfect the carrier system of the maritime law of mainland China.It provides theoretical support and experience for the full implementation of cross-strait three links and the implementation of the legal system of "one country, two systems".
