【摘要】：本文從法學(xué)特別是國際法學(xué)的視角出發(fā),通過文獻(xiàn)資料法、實證研究法、比較研究法及歷史研究法,融合其他學(xué)科相關(guān)知識,沿著《國際貨幣基金協(xié)定》框架下特別提款權(quán)(Special Drawing Right,SDR)的基本理念分析到對人民幣加入SDR后基于“可自由使用標(biāo)準(zhǔn)”的要求我國在國際貨幣基金組織(International Monetary Fund,IMF)的法律權(quán)利義務(wù)轉(zhuǎn)變和履行義務(wù)的困境分析及其應(yīng)對的法律對策的思路進(jìn)行,概括總結(jié)了《國際貨幣基金協(xié)定》下SDR的涵義與法律特征、定值與進(jìn)入機(jī)制和其使用及功用,對中國在IMF的法律權(quán)利義務(wù)新變化以及中國在履行相關(guān)法律義務(wù)方面存在的困境進(jìn)行了分析,并提出解決的法律對策,主要是加強(qiáng)我國與其他國家金融合作促進(jìn)人民幣地位提升、進(jìn)一步推動SDR制度改革以及完善國內(nèi)相關(guān)金融法律制度。
[Abstract]:From the perspective of law, especially international law, this paper combines the relevant knowledge of other disciplines through the methods of literature, empirical research, comparative research and historical research.Along the lines of the basic idea of the Special Drawing right (SDR) under the framework of the International Monetary Fund Agreement, this paper analyzes the requirements of China's International Monetary Fund (IMF) law on the admission of the renminbi to the SDR based on the "standards of free use".The analysis of the dilemma of the transformation of rights and obligations and the implementation of their obligations and the legal countermeasures to deal with them are carried out.This paper summarizes the meaning and legal characteristics of SDR under the Agreement of the International Monetary Fund, the mechanism of valuation and entry, and its use and function.This paper analyzes the new changes of China's legal rights and obligations in IMF and the difficulties existing in China's implementation of relevant legal obligations, and puts forward legal countermeasures to solve them.It is mainly to strengthen the financial cooperation between China and other countries to promote the status of RMB, to further promote the reform of the SDR system and to improve the domestic financial legal system.
