【摘要】：在金融危機背景下,中美貿(mào)易摩擦頻發(fā),如何利用WTO爭端解決機制以解決中美貿(mào)易摩擦,如何充分運用入世權(quán)利對于我國維護良好的國際貿(mào)易環(huán)境是至關(guān)重要,但是從我國入世以來的實踐來看,在中美貿(mào)易摩擦中以當事方身份參加的案件數(shù)量極為有限,這與我國頻繁遭受美國爭端調(diào)查的現(xiàn)狀極其不符。由此可見在充分利用世貿(mào)組織的權(quán)利方面我國還有很長的路要走。 本文研究如何運用WTO爭端解決機制解決中美貿(mào)易摩擦的問題,通過利用WTO爭端解決機制解決中美貿(mào)易摩擦的情況進行分析,找出中國對WTO爭端解決機制利用效率低下的原因,以及分析出WTO爭端解決機制對我國的積極影響,指出中國入世后運用WTO爭端解決機制解決中美貿(mào)易摩擦的重要性和必要性;其次,結(jié)合我國在金融危機背景下的處境和加入WTO之后的實踐,根據(jù)我國所面臨的問題提出相應(yīng)的對策:從加強對WTO爭端解決機制的研究和利用,到力爭完善爭端解決機制,培育符合WTO規(guī)范的國內(nèi)環(huán)境,從而使得我國能更好地利用WTO爭端解決機制來處理中美貿(mào)易糾紛。
[Abstract]:Under the background of the financial crisis, the frequent trade frictions between China and the United States, how to use the dispute settlement mechanism of WTO to solve the trade friction between China and the United States, and how to make full use of the right to join the WTO is of great importance for our country to maintain a good international trade environment.However, from the practice of China's entry into WTO, the number of cases involving as parties in Sino-US trade frictions is extremely limited, which is extremely inconsistent with the current situation of our country being frequently investigated by the United States.This shows that China has a long way to go in making full use of the rights of the WTO.This paper studies how to use the WTO dispute settlement mechanism to solve the trade frictions between China and the United States. Through the analysis of the use of the WTO dispute settlement mechanism to resolve the trade friction between China and the United States, the author finds out the reasons for the inefficiency of China's use of the WTO dispute settlement mechanism.It also analyzes the positive influence of the WTO dispute settlement mechanism on China, and points out the importance and necessity of using the WTO dispute settlement mechanism to solve the trade frictions between China and the United States after China's entry into WTO.Combining the situation of our country under the background of the financial crisis and the practice after joining WTO, this paper puts forward the corresponding countermeasures according to the problems that our country faces: from strengthening the research and utilization of the dispute settlement mechanism of WTO, to striving to perfect the dispute settlement mechanism.To cultivate the domestic environment which conforms to the WTO standard, so that our country can make better use of the WTO dispute settlement mechanism to deal with the trade dispute between China and the United States.
