【摘要】：在WTO多邊自由貿(mào)易談判受阻的今天,簽訂雙邊自由貿(mào)易協(xié)定,加入?yún)^(qū)域性自由貿(mào)易區(qū)成了眾多國家的共同選擇。我國自“十七大”提出實施自由貿(mào)易區(qū)戰(zhàn)略以來,加快了雙邊自由貿(mào)易的談判。截止目前,我國已經(jīng)簽署的自由貿(mào)易協(xié)議有13個,正在談判中的自由貿(mào)易協(xié)議有8個,雙邊和區(qū)域性自由貿(mào)易區(qū)的建設(shè)已經(jīng)成為了我國經(jīng)濟外向型發(fā)展的動力來源。研究、制定最適合我國目前經(jīng)濟體制的原產(chǎn)地規(guī)則,對于我國充分利用自貿(mào)區(qū)建設(shè)實施“走出去”的發(fā)展戰(zhàn)略具有十分重要的意義。原產(chǎn)地規(guī)則是優(yōu)惠性貿(mào)易協(xié)定中用于判定“貨物來源國”的規(guī)則,是區(qū)域優(yōu)惠貿(mào)易談判中的重要議題,是一國貿(mào)易政策的風(fēng)向標。原產(chǎn)地規(guī)則在國際貿(mào)易中的作用也由最初為方便海關(guān)進行貿(mào)易國別統(tǒng)計、標記貨物原產(chǎn)國,發(fā)展成為現(xiàn)在的除傳統(tǒng)關(guān)稅壁壘之外的又一種新型非關(guān)稅貿(mào)易壁壘。對于自由貿(mào)易區(qū)而言,原產(chǎn)地規(guī)則發(fā)揮著降低外來競爭,保護區(qū)內(nèi)成員國的作用。本文選取我國最新簽訂的中國與澳大利亞自由貿(mào)易協(xié)定中原產(chǎn)地規(guī)則為具體研究對象。第一章研究了原產(chǎn)地規(guī)則的基本問題,包括原產(chǎn)地規(guī)則的產(chǎn)生發(fā)展、判定標準、原產(chǎn)地規(guī)則的分類及其對國際經(jīng)濟的影響等；第二章介紹了當今世界上存在的兩大主流原產(chǎn)地規(guī)則模式；第三章介紹了中澳自貿(mào)協(xié)定的概況,也對中澳自貿(mào)協(xié)定中原產(chǎn)地規(guī)則進行了介紹,指出中澳自貿(mào)協(xié)定中原產(chǎn)地規(guī)則存在的不足；最后一章提出了針對不足之處的完善措施建議。
[Abstract]:Today, when the multilateral free trade negotiations of WTO are blocked, signing bilateral free trade agreements and joining regional free trade zones has become the common choice of many countries. Since the 17th National Congress of China put forward the implementation of free trade area strategy, Bilateral free trade negotiations have been accelerated. So far, China has signed 13 free trade agreements and 8 free trade agreements are under negotiation. The construction of bilateral and regional free trade zones has become the driving force for the export-oriented development of China's economy. It is of great significance for our country to make full use of the construction of the free trade zone to implement the development strategy of "going out". Rules of origin are the rules used in preferential trade agreements to determine the "origin of goods". It is an important topic in regional preferential trade negotiations and a vane of a country's trade policy. The role of rules of origin in international trade has also been changed from the first to facilitate customs trade national statistics, marking countries of origin of goods, It has become a new type of non-tariff trade barrier in addition to traditional tariff barriers. For free trade zones, rules of origin play a role in reducing foreign competition. The role of the member countries in the protected areas. This paper selects the rules of origin in the newly signed Free Trade Agreement between China and Australia as the specific research object. Chapter one studies the basic issues of the rules of origin. It includes the origin and development of rules of origin, the criteria of decision, the classification of rules of origin and its influence on international economy, etc. The second chapter introduces the two main patterns of rules of origin in the world. The third chapter introduces the general situation of China-Australia Free Trade Agreement, also introduces the rules of origin of China-Australia Free Trade Agreement, points out the shortcomings of the rules of origin in the Sino-Australian Free Trade Agreement.
