【摘要】：在全球經(jīng)濟(jì)一體化的今天，國與國之間的交往日益密切，尤其在民商事領(lǐng)域的交往更是頻繁，隨之而來的是民事爭議的不斷增加。涉外民商事訴訟作為解決爭議一種機(jī)制，在現(xiàn)代社會(huì)中發(fā)揮著及其重要的作用，管轄權(quán)的確定是涉外民商事訴訟的前提，也是一國司法主權(quán)的體現(xiàn)。世界上各個(gè)國家從自己社會(huì)公共利益及國民利益出發(fā)，可能會(huì)擴(kuò)大或拒絕行使自己的涉外民事訴訟的管轄權(quán)，這就不可避免地會(huì)造成管轄權(quán)的沖突。這種管轄權(quán)的沖突，不僅使得但當(dāng)事人之間的糾紛難以得到解決，而且嚴(yán)重影響了各國間正常的經(jīng)濟(jì)交往。本文從我國關(guān)于解決涉外民事訴訟管轄權(quán)沖突的立法、司法及實(shí)踐出發(fā)，借鑒其他國家的先進(jìn)經(jīng)驗(yàn)，，闡述完善我國涉外民事訴訟管轄權(quán)制度的構(gòu)想。
[Abstract]:With the globalization of the global economy, the exchanges between countries are becoming more and more close, especially in the field of civil and commercial affairs, especially in the field of civil and commercial affairs, which is accompanied by an increasing number of civil disputes. As a mechanism for resolving disputes, civil and commercial litigation involving foreign countries is a mechanism for resolving disputes. In modern society, the determination of jurisdiction is the premise of foreign civil and commercial litigation, and also the embodiment of a country's judicial sovereignty. All countries in the world proceed from their own social public interests and national interests. It may expand or refuse to exercise its jurisdiction over foreign civil proceedings, which inevitably results in a conflict of jurisdiction, which not only makes it difficult to resolve disputes between the parties, This paper, based on the legislation, judicature and practice of resolving the conflicts of jurisdiction in civil litigation involving foreign countries, draws on the advanced experience of other countries. This paper expounds the idea of perfecting the jurisdiction system of civil litigation concerning foreign affairs in our country.
