論實際承運人的法律地位——從“指導(dǎo)案例51號”切入

【摘要】:實際承運人并非運輸合同當(dāng)事人,相關(guān)國際公約和我國法律卻規(guī)定其對旅客/托運人承擔(dān)合同責(zé)任,這突破了"合同相對性原則"。明確其法律地位,厘清其從事運輸?shù)姆申P(guān)系,是準(zhǔn)確適用法律的前提。"指導(dǎo)案例51號"中法院判決實際承運人對旅客承擔(dān)合同責(zé)任,但或許因理論準(zhǔn)備不足,論證過程中回避了這一疑難問題,其指導(dǎo)性價值難免受限。相較于履行輔助人,利他合同債務(wù)人是實際承運人法律地位的合理解釋。實際承運人法律地位的研究對我國國際國內(nèi)物流大通道建設(shè)和"一帶一路"戰(zhàn)略的實施具有重大現(xiàn)實意義。
[Abstract]:The actual carrier is not a party to the contract of carriage, but the relevant international conventions and the law of our country stipulate that the carrier bears contractual liability to the passenger / shipper, which breaks through the "principle of relativity of contract" and clarifies its legal status. It is a prerequisite for the accurate application of the law to clarify the legal relationship of the carrier engaged in transport. In "guiding case 51", the court ruled that the actual carrier should bear contractual responsibility for the passenger, but perhaps due to inadequate theoretical preparation, the difficult question was avoided in the course of argumentation. Its guiding value is bound to be limited. Altruistic contract debtor is a reasonable explanation of the actual carrier's legal status. The study of the actual carrier's legal status is of great practical significance to the construction of China's international and domestic logistics channels and the implementation of "Belt and Road" strategy.
