【摘要】：世界貿(mào)易組織爭端解決機(jī)制在整個(gè)WTO法律體系中具有核心地位,為多邊貿(mào)易體制提供了有力的執(zhí)行保障。倘若沒有該機(jī)制,各成員之間頻繁出現(xiàn)的貿(mào)易爭糾紛將無法得以有效的解決。如果真是如此,則任何WTO的實(shí)體規(guī)則就將難以逃脫淪為一紙空文的命運(yùn),WTO體系也將失去其存在的意義。也正因?yàn)槿绱?世界貿(mào)易組織爭端解決機(jī)制才被視為“世界貿(mào)易組織最獨(dú)特的貢獻(xiàn)”,它更被普遍認(rèn)為是迄今為止國際經(jīng)貿(mào)領(lǐng)域最有成就和執(zhí)行最為有力的法律保障手段。WTO的運(yùn)行程序主要體現(xiàn)在《關(guān)于爭端解決的程序與規(guī)則諒解》及其附件中,這些程序包括：磋商程序、專家組程序、上訴程序和執(zhí)行程序四個(gè)階段或部分。本文就是從以上四個(gè)階段展開了論述的,文章由三部分組成,第一部分對以上四個(gè)階段做了概述；第二部分分別論述了以上四個(gè)所存在的問題；第三部分就以上所涉問題的改革進(jìn)行了系統(tǒng)的研究。
[Abstract]:The dispute settlement mechanism of the World Trade Organization (WTO) plays a central role in the entire WTO legal system and provides effective enforcement guarantees for the multilateral trading system. Frequent trade disputes among members will not be effectively resolved. Any substantive rules of the WTO would be hard to escape the fate of a dead letter. The WTO system would also lose its existence. The dispute settlement mechanism of the World Trade Organization (WTO) is regarded as "the most unique contribution of the World Trade Organization", and it is generally considered to be the most successful and effective legal safeguard in the field of international trade and economy to date. The procedure is primarily reflected in the understanding on procedures and rules for dispute settlement and its annexes, These procedures include four stages or parts: consultation procedure, expert group procedure, appeal procedure and enforcement procedure. The first part gives an overview of the above four stages; the second part discusses the problems existing in the above four; the third part makes a systematic study on the reform of the above mentioned problems.
