【摘要】：在中國的香港、澳門、臺灣和大陸地區(qū),出現(xiàn)了一個國家,兩種社會制度,三種法系,四個法律差異很大的法域這種情況,導致了民事法律關(guān)系適用的沖突,也當然導致了中國區(qū)際繼承制度的法律沖突。誠然,中國區(qū)際繼承法律沖突,是中國特定歷史條件下的產(chǎn)物,在四地政治、經(jīng)濟、文化、道德各方面相互交流、影響、滲透、融合的過程中,這種沖突將會逐漸減少,直至完全消失。但是,這是一個十分漫長的過程。當務(wù)之急,應該著手如何協(xié)調(diào)這種法律沖突。本文主要以比較分析方法,通過比較中國四個地區(qū)的繼承法律規(guī)范和沖突規(guī)則,提出了協(xié)調(diào)四個地區(qū)繼承制度法律沖突的建議。 第一部分:闡述了繼承制度的概念和中國區(qū)際繼承制度的法律沖突形成的原因及特點。本部分介紹了繼承的概念、含義和主要的分類方式,以及中國出現(xiàn)一個國家、兩種社會制度、三種法系和四個法域的主要原因,中國區(qū)際繼承制度法律沖突的特點。 第二部分:中國區(qū)際繼承制度的比較。本部分用比較分析方法,闡述了中國大陸、香港、澳門和臺灣四個地區(qū)在法定繼承、遺囑繼承以及遺贈這三個方面繼承制度的主要區(qū)別。 第三部分:中國區(qū)域繼承制度的法律沖突規(guī)范比較。本部分通過比較中國大陸、香港、澳門、臺灣四個地區(qū)的繼承沖突規(guī)范,詳細闡述了中國四個地區(qū)在法定繼承、遺囑繼承以及遺贈這三個方面的法律沖突。 第四部分:中國區(qū)際繼承制度法律沖突的協(xié)調(diào)。本部分通過論證各種解決中國區(qū)際繼承法律沖突的方法,提出了四個地區(qū)協(xié)商制定協(xié)議以解決四個地區(qū)的繼承法律沖突,并提出具體的建議。 第五部分:結(jié)論。本部分得出結(jié)論,在目前制定全國統(tǒng)一的區(qū)際沖突法有相當難度,簽訂協(xié)議規(guī)范繼承制度的沖突規(guī)范才是可取的方法。
[Abstract]:In Hong Kong, Macao, Taiwan and the mainland of China, there has been a conflict in the application of civil legal relations in one country, two social systems, three legal systems, and four jurisdictions with very different laws. Of course, this has led to the conflict of laws in China's inter-regional succession system. Admittedly, the conflict of law on inter-regional succession in China is the product of specific historical conditions in China, which exchanges, influences and penetrates among the four political, economic, cultural and moral aspects. In the process of integration, this kind of conflict will gradually decrease, until it will disappear completely. However, it is a very long process. By comparing the legal norms and conflict rules of inheritance in four regions of China, this paper puts forward some suggestions to coordinate the conflicts of laws in the four regions. Part I: the concept of inheritance system and the causes and characteristics of the conflict of laws in China's inter-regional succession system. This part introduces the concept, meaning and main classification of inheritance, as well as the emergence of a country in China. The main causes of two social systems, three legal systems and four jurisdictions, and the characteristics of the conflict of laws in China's inter-regional inheritance system. The second part: the comparison of China's inter-regional inheritance system. This part, by means of comparative analysis, expounds the legal succession of mainland China, Hong Kong, Macao and Taiwan. The main differences of succession system in testamentary succession and bequest. The third part: the comparison of the conflicts of laws in China's regional succession system. By comparing the conflict norms of China's mainland, Hong Kong, Macao and Taiwan, this part expounds in detail the legal succession of the four regions of China. The conflicts of laws in the three aspects of testamentary succession and bequest. The fourth part: the coordination of the conflict of laws in the system of inter-regional succession in China. Through the demonstration of various methods to resolve the conflicts of laws of succession between regions of China, this part proposes four regions to negotiate and formulate agreements to resolve the conflicts of succession laws in the four regions. And put forward concrete suggestion. The fifth part: conclusion. This part draws the conclusion that it is very difficult to make the national unified interregional conflict law at present, and it is advisable to sign the conflict norm of the agreement norm inheritance system.
