【摘要】：電信服務(wù)作為GATS中的一部分,它關(guān)系到世界各個(gè)國家和地區(qū)的社會(huì)進(jìn)步和經(jīng)濟(jì)發(fā)展,對(duì)其有重要的作用,電信服務(wù)不僅帶動(dòng)經(jīng)濟(jì)發(fā)展,而且也關(guān)系到國家的安全與利益,所以各個(gè)國家在對(duì)其開放時(shí)都持謹(jǐn)慎態(tài)度。 本文以GATS以及基礎(chǔ)電信協(xié)議等相關(guān)規(guī)則為背景,分析研究了GATS下國際電信服務(wù)貿(mào)易的市場(chǎng)準(zhǔn)入規(guī)則,認(rèn)真剖析并借鑒其他國家在開放電信服務(wù)過程中處理市場(chǎng)準(zhǔn)入問題的經(jīng)驗(yàn)教訓(xùn),并結(jié)合中國電信服務(wù)現(xiàn)有的立法環(huán)境深入思考,對(duì)中國的電信服務(wù)提出一些完善的意見。 本文主要分五個(gè)部分進(jìn)行了闡述: 第一部分,國際電信服務(wù)市場(chǎng)準(zhǔn)入制度概述,主要對(duì)國際電信服務(wù)的界定和國際電信服務(wù)市場(chǎng)準(zhǔn)入的界定,對(duì)這些內(nèi)容有總體的認(rèn)識(shí)。 第二部分,國際電信服務(wù)市場(chǎng)準(zhǔn)入的規(guī)定,介紹了GATS對(duì)國際電信服務(wù)市場(chǎng)準(zhǔn)入的一般規(guī)定和特別規(guī)定,還闡述了GATS服務(wù)貿(mào)易具體承諾的內(nèi)容,《基礎(chǔ)電信協(xié)議》對(duì)市場(chǎng)準(zhǔn)入的一般規(guī)定及其影響,以及WTO新一輪談判的部分內(nèi)容。 第三部分,典型國家電信服務(wù)市場(chǎng)準(zhǔn)入的現(xiàn)狀,主要對(duì)巴西,印度和俄羅斯三國的電信服務(wù)市場(chǎng)準(zhǔn)入制度進(jìn)行了分析,并闡述了三國電信服務(wù)市場(chǎng)準(zhǔn)入的積極作用和消極作用,以及對(duì)我國的啟示。 第四部分,我國電信服務(wù)市場(chǎng)準(zhǔn)入的現(xiàn)狀分析,主要對(duì)我國電信服務(wù)市場(chǎng)發(fā)展歷程進(jìn)行了闡述,并且詳細(xì)論述了目前我國電信服務(wù)所存在的問題與不足。 第五部分,我國電信服務(wù)市場(chǎng)準(zhǔn)入的完善,針對(duì)我國電信服務(wù)所存在的問題與不足,提出了自己的一些建議。
[Abstract]:As a part of GATS, telecommunication service is related to the social progress and economic development of every country and region in the world, and plays an important role in it. Telecommunication service not only drives the economic development, but also relates to the security and interests of the country. So countries are cautious about opening up to them. Based on the relevant rules of GATS and basic telecommunication protocol, this paper analyzes and studies the market access rules of international telecommunication service trade under GATS. This paper analyzes and draws lessons from other countries' experiences and lessons in dealing with market access problems in the process of opening up telecommunication services, and puts forward some perfect opinions on China's telecommunication services in the light of the existing legislative environment of China's telecommunication services. This paper is mainly divided into five parts:. The first part is an overview of the market access system of international telecommunication services, mainly the definition of international telecommunication services and the definition of market access of international telecommunications services, and has a general understanding of these contents. The second part introduces the general and special provisions of GATS on market access for international telecommunication services. The contents of the specific commitments of GATS trade in services, the general provisions of the basic Telecommunications Agreement on market access and their effects, as well as some of the contents of the new round of WTO negotiations are also expounded. The third part, the status quo of telecom service market access in typical countries, mainly analyzes the market access system of telecommunications services in Brazil, India and Russia. It also expounds the positive and negative effects of market access of telecommunication services in the three countries and the enlightenment to our country. The fourth part, the present situation analysis of our country telecommunication service market access, mainly has carried on the elaboration to our country telecommunication service market development course, and has discussed the present our country telecommunication service existence question and the insufficiency in detail. The fifth part, the consummation of the market access of telecommunication service in our country, aiming at the problems and shortcomings of the telecommunication service in our country, some suggestions are put forward.
