南海維權(quán)視角內(nèi)航標(biāo)管控法律問(wèn)題研究

【摘要】:當(dāng)前,南海島礁主權(quán)爭(zhēng)端形勢(shì)嚴(yán)峻,我國(guó)需積極運(yùn)用國(guó)際法中解決領(lǐng)土爭(zhēng)端的理論有理有據(jù)地維護(hù)南海權(quán)益。作為國(guó)際法院領(lǐng)土爭(zhēng)議案件裁判規(guī)則的有效管控原則適合于成為我國(guó)南海維權(quán)的理論支撐。有效管控原則以國(guó)家權(quán)力的有效行使為核心,而國(guó)家立法、行政、司法權(quán)力構(gòu)成國(guó)家權(quán)力的主要方面。本文借助航標(biāo)這一國(guó)際通行的低敏感性海上助航工具,將南海航標(biāo)管控作為我國(guó)踐行有效管控原則的體現(xiàn)。既然航標(biāo)管控以貫徹有效管控原則、彰顯國(guó)家權(quán)力的有效行使為目標(biāo),那么航標(biāo)管控的內(nèi)容應(yīng)包括航標(biāo)相關(guān)立法規(guī)制、航標(biāo)行政執(zhí)法和航標(biāo)刑事司法保護(hù)三方面。然而,現(xiàn)階段南海航標(biāo)立法、航標(biāo)行政執(zhí)法、航標(biāo)刑事司法保護(hù)三方面存在的缺陷,已經(jīng)在一定程度上掣肘南海航標(biāo)管控維權(quán)效果的發(fā)揮。為了深化南海航標(biāo)管控對(duì)南海維權(quán)的促進(jìn)作用,本文在結(jié)合南海海域的特殊性及南海維權(quán)現(xiàn)實(shí)需求的基礎(chǔ)上,為南海航標(biāo)相關(guān)立法、行政執(zhí)法、刑事司法保護(hù)三方面存在的問(wèn)題提供法律建議,對(duì)實(shí)踐工作中存在的缺陷予以填補(bǔ),以期通過(guò)航標(biāo)管控切實(shí)維護(hù)我國(guó)南海權(quán)益。本文共分為四章。第一章分別論述了以有效管控原則維護(hù)南海權(quán)益的策略,以及航標(biāo)管控與有效管控原則之間的關(guān)系,建立了航標(biāo)管控與南海維權(quán)之間的有機(jī)聯(lián)系。第二章通過(guò)對(duì)比航標(biāo)法律規(guī)范及相關(guān)法律當(dāng)中的規(guī)定,分析立法中存在的問(wèn)題與缺陷,并對(duì)其予以適當(dāng)性解決和填補(bǔ)。第三章明確了南海航標(biāo)執(zhí)法的特殊性,介紹了南海航標(biāo)執(zhí)法主體與內(nèi)容,通過(guò)對(duì)比分析現(xiàn)有體制與南海維權(quán)目標(biāo)的不適性,闡述現(xiàn)有南海航標(biāo)行政執(zhí)法體制的不合理之處,并提出完善建議。第四章中分析了南海航標(biāo)刑事司法保護(hù)對(duì)南海維權(quán)的積極意義,然而南海涉航標(biāo)案件刑事司法審判實(shí)踐一直處于缺位狀態(tài)。根據(jù)有效管控原則的構(gòu)成要件,南海航標(biāo)刑事司法保護(hù)應(yīng)滿(mǎn)足有效、長(zhǎng)期、公開(kāi)等三方面要求,本章從三方面入手厘清現(xiàn)階段南海刑事司法體制的不足之處,并在此基礎(chǔ)上為填補(bǔ)南海涉航標(biāo)案件刑事司法審判的疏漏之處,提出針對(duì)性建議。
[Abstract]:At present, the situation of the sovereignty dispute over islands and reefs in the South China Sea is grim. China should actively use the theory of territorial dispute settlement in international law to protect the rights and interests of the South China Sea. As an effective principle of control and control in territorial dispute cases of the International Court of Justice, it is suitable to become the theoretical support for safeguarding the rights of China's rights in the South China Sea. The principle of effective governance is centred on the effective exercise of State authority, The national legislative, administrative and judicial powers constitute the main aspects of state power. Since the aim of navigation mark control is to implement the effective control principle and highlight the effective exercise of state power, the contents of navigation mark control should include the legal regulation of navigation aids. However, at the present stage, there are some defects in the legislation of navigation aids in the South China Sea, the administrative enforcement of navigation marks, and the criminal judicial protection of navigation aids. In order to deepen the role of navigation aids control in promoting the South China Sea rights protection, this paper combines the particularity of the South China Sea waters and the practical needs of the South China Sea rights protection. To provide legal advice for the related legislation, administrative law enforcement and criminal judicial protection in the South China Sea, and to fill in the defects in practice. This paper is divided into four chapters. The first chapter discusses the strategy of maintaining the rights and interests of the South China Sea by the principle of effective control, and the relationship between the control of navigation aids and the principle of effective control. The second chapter analyzes the problems and defects in the legislation by comparing the legal norms of navigation aids and the provisions of relevant laws, and establishing an organic link between the control of navigation aids and the protection of rights in the South China Sea. The third chapter clarifies the particularity of the navigation mark enforcement in the South China Sea, introduces the subject and content of the navigation mark enforcement in the South China Sea, and analyzes the discomfort of the existing system and the goal of safeguarding the rights of the South China Sea by comparing the existing system and the goal of safeguarding the rights of the South China Sea. This paper expounds the irrationality of the existing administrative law enforcement system of navigation aids in the South China Sea, and puts forward some suggestions for perfection. Chapter 4th analyzes the positive significance of the criminal judicial protection of navigation aids in the South China Sea for safeguarding the rights of the South China Sea. However, the criminal judicial practice of navigation aids cases in the South China Sea has been in a state of absence. According to the constitutive elements of the principle of effective control, the criminal judicial protection of navigation aids in the South China Sea should meet the requirements of effective, long-term and open. This chapter begins with three aspects to clarify the deficiencies of the present criminal justice system in the South China Sea and on this basis to fill the gaps in the South China Sea navigation related cases of criminal justice and put forward targeted recommendations.
