【摘要】：水權(quán)是一項基本人權(quán)。然而,晚近以來國際投資條約的自由化和國際投資仲裁實踐中過分偏向于維護投資者利益的傾向,引發(fā)了國際投資仲裁中的"水權(quán)危機",嚴重損害了東道國人民的水權(quán)權(quán)益。東道國在涉及水權(quán)的國際投資仲裁中提出人權(quán)抗辯是應(yīng)對這種危機的應(yīng)急之策,而危機的根本解決在于對國際投資條約的人權(quán)化革新,最終實現(xiàn)維護東道國人民水權(quán)利益與保護外國投資者財產(chǎn)利益在國際投資仲裁中的適當(dāng)平衡。
[Abstract]:The right to water is a fundamental human right. However, in recent times, the liberalization of international investment treaties and the practice of international investment arbitration have tended to favour the interests of investors, Causing the "water right crisis" in international investment arbitration and seriously harming the rights and interests of the people of the host country. It is an emergency strategy for the host country to raise human rights defences in international investment arbitration involving the right to water, The fundamental solution of the crisis lies in the innovation of the human rights of the international investment treaties and the realization of the proper balance between the protection of the people's right to water in the host country and the protection of the property interests of foreign investors in the international investment arbitration.
