【摘要】
憲法實施中的違憲審查機制與憲法訴訟方式是兩種不同機制的區(qū)別。在分析西方國家憲法實施的路徑,以及中國實行憲法監(jiān)督走違憲審查之路面臨的困難后,根據(jù)違憲審查與憲法訴訟相別的理論,提出中國的憲法司法化方案,即違憲審查權(quán)仍由全國人大常委會行使,而由最高法院承擔(dān)憲法訴訟的任務(wù)。
