【摘要】：鑒于國際人權(quán)條約與一般國際條約所存在的差異，包括其本身所規(guī)定的法律關(guān)系的特殊性、區(qū)別于一般國際條約在國內(nèi)適用的差異性以及當(dāng)前我國面臨的如何解決國際人權(quán)條約在國內(nèi)適用的緊迫性，因此，本文通過考察各國適用國際人權(quán)條約的立法和司法實踐而著重討論國際人權(quán)條約在國內(nèi)的適用問題。本文從分析直接適用和間接適用方式這兩種傳統(tǒng)的條約適用方式所存在的利弊以及在采取這兩種適用方式時所需要注意的可能后果開始，并在直接適用和間接適用國際人權(quán)條約的基礎(chǔ)上，，通過對其他國家關(guān)于國際人權(quán)條約國內(nèi)適用的憲法和司法實踐的考察，總結(jié)出了國際人權(quán)條約適用的新方式——解釋性適用，并分析了解釋性適用方式可能解決的傳統(tǒng)適用條約所存在的問題。緊接著，通過國別分析的方式，深入研究了美國、日本、南非各國關(guān)于國際人權(quán)條約國內(nèi)適用的憲法和司法實踐存在的問題和解決的方式，得出了各國從傳統(tǒng)的直接適用和間接適用條約逐漸運用解釋性適用條約的新方式來解決國際人權(quán)條約在國內(nèi)適用所面臨的問題。最后，通過對我國國際人權(quán)條約適用現(xiàn)狀的分析和討論，總結(jié)出我國國際人權(quán)條約適用所面臨的立法缺位、適用方式不明確、是否優(yōu)先適用存疑的問題，并建議我國加快立法確立國際人權(quán)條約在我國國內(nèi)法上的法律地位，由法院在司法實踐中解決國際人權(quán)條約適用方式和優(yōu)先適用問題，并提倡法院使用解釋性適用方式解決條約適用問題。
[Abstract]:Considering the differences between international human rights treaties and international treaties in general, including the specificity of the legal relationship provided for in them, Different from the differences in the domestic application of international treaties and the urgency of how to solve the domestic application of international human rights treaties, This paper focuses on the domestic application of international human rights treaties by examining the legislative and judicial practice of the application of international human rights treaties in various countries. This paper analyzes the direct and indirect application of international human rights treaties. The pros and cons of the approach and the possible consequences that need to be taken into account in adopting both approaches, And on the basis of the direct and indirect application of international human rights treaties, and by examining the constitutional and judicial practice of other countries concerning the domestic application of international human rights treaties, the author concludes that the new mode of application of international human rights treaties-interpretative application, Then it analyzes the problems existing in the traditional application of treaties that may be solved by means of interpretative application. Then, through country analysis, it makes an in-depth study of the United States and Japan. The problems and solutions in the constitutional and judicial practice of the States of South Africa concerning the domestic application of international human rights treaties, Having come to the conclusion that States are gradually applying new means of interpretative application of treaties from traditional direct and indirect application of treaties to solve the problems faced by international human rights treaties in their domestic application... finally, Based on the analysis and discussion of the current situation of the application of international human rights treaties in China, the author concludes that the application of international human rights treaties in our country is faced with the lack of legislation, the method of application is not clear, and the question of whether the application of the international human rights treaties is preferred is doubtful. And it is suggested that our country should speed up legislation to establish the legal status of international human rights treaties in our domestic law, and let the courts solve the problems of the mode of application and priority application of international human rights treaties in judicial practice. And to promote the use of interpretative application of the Court to resolve the issue of treaty application.
