【摘要】：隨著很多難民和非安全移民選擇經(jīng)海路入境,海難事件增多�；诤Ｉ瞎芸卦陔y民與非安全移民治理中的獨(dú)立性和特有價(jià)值,海上管控前置成為一些國家和地區(qū)的首選對策。但是,難民和非安全移民海上管控前置存在制度供給缺口。海事公約因其關(guān)切對象而在整體適用上較為有限,"無效果無報(bào)酬"原則因不適用于單純的人命救助而易催生道德風(fēng)險(xiǎn),基于主權(quán)的單邊海事行動因"平等者之間無管轄權(quán)"原則而易導(dǎo)致海上管控法律制度沖突,海上犯罪懲防機(jī)制因缺少針對性和實(shí)操性而無法達(dá)到有效打擊的目的。因此,應(yīng)進(jìn)一步完善難民和非安全移民海上管控法律規(guī)制,通過"默示修正程序"加快出臺專項(xiàng)海事法律規(guī)范,通過確立人命的客體屬性、報(bào)酬的優(yōu)先受償和特別補(bǔ)償制度等途徑完善海難救助制度,創(chuàng)建信息交流共享機(jī)制,創(chuàng)新區(qū)域性制度安排。
[Abstract]:As many refugees and unsafe migrants choose to enter by sea, there has been an increase in maritime accidents. Based on the independence and unique value of maritime control in the governance of refugees and unsafe migrants, Leading maritime control has become the preferred strategy for some countries and regions. However, There is a gap in the supply of systems for maritime control of refugees and unsafe migrants. Maritime conventions are less applicable as a whole because of their concerns, and the principle of "no effect and no remuneration" is prone to moral hazard because it does not apply to the mere rescue of human life. Unilateral maritime action based on sovereignty is liable to lead to conflict of legal system of maritime control because of the principle of "no jurisdiction between equal persons", and the mechanism of punishment and prevention of crimes at sea is unable to achieve the purpose of effective attack because of the lack of pertinence and practicability. We should further improve the legal regulation of the maritime control of refugees and non-safe migrants, speed up the introduction of special maritime legal norms through the "implied amendment procedure", and establish the object attribute of human life. The compensation priority and special compensation system should be adopted to perfect the salvage system, to establish the information exchange and share mechanism, and to innovate the regional system arrangement.
