【摘要】：世界上已有很多國家對(duì)同性關(guān)系進(jìn)行了立法保護(hù),在這些國家里,同性關(guān)系會(huì)被認(rèn)可為同性婚姻、注冊(cè)伴侶關(guān)系或民事結(jié)合三種模式,這些國家也允許他國的同性伴侶在本國進(jìn)行同性結(jié)合。在對(duì)涉外同性關(guān)系進(jìn)行法律適用時(shí),由于各國對(duì)同性關(guān)系立法保護(hù)范圍的不一致,加上部分國家仍然未對(duì)同性關(guān)系進(jìn)行相關(guān)立法,一方面,容易導(dǎo)致同性關(guān)系“升級(jí)”與“降級(jí)”問題的出現(xiàn)；另一方面,也容易導(dǎo)致在一國締結(jié)的同性關(guān)系在其他國家得不到法律的認(rèn)可與保護(hù)。在這些情況下,不僅同性伴侶的合法權(quán)益不能得到很好的維護(hù),也極易使各國及各國當(dāng)事人的利益受到損害。針對(duì)世界各國在涉外同性關(guān)系法律適用中存在的問題進(jìn)行研究并提出解決對(duì)策,對(duì)于響應(yīng)世界人權(quán)口號(hào),促進(jìn)同性關(guān)系的法律保護(hù)有著積極意義,也有利于各國涉外同性關(guān)系法律適用制度的發(fā)展與完善。 本文對(duì)國內(nèi)外對(duì)同性關(guān)系的立法保護(hù)情況進(jìn)行了詳細(xì)的總結(jié)研究,分析了國內(nèi)外在涉外同性關(guān)系法律適用中存在的問題并提出了解決方案。本文的創(chuàng)新之處在于從本國及本國當(dāng)事人的立場(chǎng)出發(fā),提出對(duì)涉外同性關(guān)系法律適用制度的初步構(gòu)建,并提出了區(qū)分不同情況適用國內(nèi)公共秩序保留制度的建議,這些都具有很強(qiáng)的實(shí)用性。
[Abstract]:Many countries in the world have legislated to protect same-sex relationships, in which same-sex relationships are recognized as three modes of same-sex marriage, registered partnership or civil union. These countries also allow same-sex couples from other countries to engage in same-sex unions in their own countries. When applying the law to foreign same-sex relations, due to inconsistencies in the scope of protection of same-sex relations legislation, Coupled with the fact that some countries still do not have legislation on same-sex relations, on the one hand, it is easy to cause same-sex relations to be "upgraded" and "downgraded"; on the other hand, It is also likely that same-sex relationships concluded in one country will not be recognized and protected by law in other countries. In these cases, not only the legitimate rights and interests of same-sex couples are not well protected, Also extremely vulnerable to harm to the interests of States and their parties. To study and propose solutions to the problems existing in the legal application of same-sex relations involving foreign countries in various countries of the world, in response to the slogan of world human rights, It is of positive significance to promote the legal protection of same-sex relations, and also conducive to the development and improvement of the legal application system of foreign same-sex relations. This article has carried on the detailed summary research to the domestic and foreign to the same-sex relations legislation protection situation, This paper analyzes the problems existing in the application of foreign same-sex relations at home and abroad and puts forward solutions. The innovation of this paper lies in the preliminary construction of the legal application system of foreign same-sex relations from the standpoint of our country and its parties. Some suggestions are put forward to distinguish the reservation system of domestic public order from different situations, all of which have strong practicability.
