WTO框架下我國農(nóng)業(yè)環(huán)境補貼法律體系研究

【摘要】:我國加入世界貿(mào)易組織后,制定了糧食直接補貼、良種補貼等優(yōu)惠政策。農(nóng)業(yè)補貼政策的實施大大調(diào)動了農(nóng)業(yè)生產(chǎn)者的生產(chǎn)積極性,推動了農(nóng)業(yè)生產(chǎn)的發(fā)展,基本實現(xiàn)了糧食增產(chǎn)和農(nóng)民增收的政策目標,但由于我國的農(nóng)業(yè)補貼政策體系還不健全,與農(nóng)業(yè)環(huán)境補貼相關(guān)的政策規(guī)定的還很少,農(nóng)業(yè)補貼政策的實施在一定程度上影響了農(nóng)業(yè)環(huán)境,因此有必要建立一種與環(huán)境緊密結(jié)合的農(nóng)業(yè)補貼政策。雖然我國出臺了一些農(nóng)業(yè)環(huán)境補貼政策,然而這些環(huán)境補貼政策存在一系列問題,如補貼項目過于集中,涉及面窄等。同時我國并沒有對此立法,更沒有形成法律體系,制定一部農(nóng)業(yè)環(huán)境補貼法已迫在眉睫。因此,本文在現(xiàn)有理論研究成果和國外實踐經(jīng)驗基礎(chǔ)上,提出了農(nóng)業(yè)環(huán)境補貼的立法建議。 本文的邏輯結(jié)構(gòu)如下: 第一部分:引言。首先在引言中說明了該篇論文的選題背景、論文的寫作目的和意義,以及這篇文論文的研究方法。 第二部分:農(nóng)業(yè)環(huán)境補貼相關(guān)理論。本部分主要論述了農(nóng)業(yè)環(huán)境補貼的概念、種類以及實施效應(yīng),并對支撐農(nóng)業(yè)環(huán)境補貼的理論進行闡述,在此基礎(chǔ)上又介紹了WTO框架下農(nóng)業(yè)環(huán)境補貼的法律依據(jù)。這些法律依據(jù)不僅包括國際法律依據(jù),還包括國內(nèi)相關(guān)立法,為我國農(nóng)業(yè)環(huán)境補貼提供法律依據(jù)。這一部分是全文的基礎(chǔ)。 第三部分:農(nóng)業(yè)環(huán)境補貼立法的必要性。在這一部分,首先對農(nóng)業(yè)補貼與農(nóng)業(yè)環(huán)境的關(guān)系進行了說明,即農(nóng)業(yè)補貼在一定程度上影響了農(nóng)村環(huán)境。又對我國農(nóng)業(yè)環(huán)境現(xiàn)狀進行分析,我國農(nóng)業(yè)環(huán)境污染形勢嚴峻,從現(xiàn)實意義上說明農(nóng)業(yè)環(huán)境補貼立法的必要性;其次對我國農(nóng)業(yè)環(huán)境補貼政策進行分析,找出其不足,從立法層面上說明農(nóng)業(yè)環(huán)境補貼立法的必要性。 第四部分:國外農(nóng)業(yè)環(huán)境補貼的規(guī)定。對國外農(nóng)業(yè)環(huán)境補貼的政策、立法進行介紹,主要從農(nóng)業(yè)環(huán)境的補貼標準、農(nóng)業(yè)環(huán)境補貼中的公眾參與及政府、農(nóng)業(yè)生產(chǎn)者的責任這幾方面進行介紹,對我國農(nóng)業(yè)環(huán)境補貼立法具有借鑒意義。 第五部分:我國農(nóng)業(yè)環(huán)境補貼的立法建議。這部分是本文的重點也是本文的創(chuàng)新點。筆者在立法建議時對農(nóng)業(yè)環(huán)境補貼的立法主體、農(nóng)業(yè)環(huán)境補貼的支付對象、補貼范圍和補貼標準作了明確規(guī)定,并對農(nóng)業(yè)環(huán)境補貼法中的政府責任、農(nóng)業(yè)生產(chǎn)者的責任進行了設(shè)置。為了保證農(nóng)業(yè)環(huán)境補貼能夠足額發(fā)放到農(nóng)業(yè)生產(chǎn)者手中,保護其權(quán)利,在農(nóng)業(yè)環(huán)境補貼立法建議中對救濟方式也進行了說明。為了能達到農(nóng)業(yè)環(huán)境補貼的立法目的,本文在程序方面也做了其他的一些說明。
[Abstract]:After China's accession to the World Trade Organization, it has formulated preferential policies such as direct subsidies for grain and subsidies for improved varieties. The implementation of the policy of agricultural subsidies has greatly aroused the production enthusiasm of agricultural producers and promoted the development of agricultural production. The policy objectives of increasing grain production and increasing farmers' income have basically been achieved. However, as the agricultural subsidy policy system in China is not perfect, there are few policies related to agricultural environmental subsidies. The implementation of agricultural subsidy policy has affected the agricultural environment to some extent, so it is necessary to establish an agricultural subsidy policy which is closely integrated with the environment. However, there are a series of problems in these environmental subsidy policies, such as the concentration of subsidy items, narrow coverage and so on. At the same time, our country has not legislated on it, let alone formed a legal system, so it is urgent to formulate an agricultural environmental subsidy law. On the basis of existing theoretical research results and foreign practical experience, this paper puts forward some legislative suggestions on agricultural environmental subsidy. The logical structure of this article is as follows:. The first part is the introduction. Firstly, the background of the thesis, the purpose and significance of the thesis, and the research method of the thesis are explained in the introduction. The second part: the related theories of agricultural environmental subsidy. This part mainly discusses the concept, types and implementation effect of agricultural environmental subsidy, and expounds the theory of supporting agricultural environmental subsidy. On this basis, it also introduces the legal basis of agricultural environmental subsidy under the framework of WTO. These legal bases include not only the international legal basis, but also the relevant domestic legislation. Provide legal basis for agricultural environmental subsidy in China. This part is the basis of the full text. The third part: the necessity of agricultural environmental subsidy legislation. In this part, the relationship between agricultural subsidy and agricultural environment is explained. That is, agricultural subsidies affect the rural environment to a certain extent, and the current situation of agricultural environment in China is analyzed. The situation of agricultural environmental pollution in China is severe, which explains the necessity of legislation on agricultural environmental subsidies in a practical sense. Secondly, it analyzes the agricultural environmental subsidy policy in China, finds out its deficiency, and explains the necessity of agricultural environmental subsidy legislation from the legislative level. Part 4th: the regulation of foreign agricultural environmental subsidy. The policy and legislation of foreign agricultural environmental subsidy are introduced, mainly from the agricultural environment subsidy standard, the public participation in agricultural environment subsidy and the government, The introduction of the responsibility of agricultural producers is of great significance to the legislation of agricultural environmental subsidy in China. Part 5th: the legislative suggestion of agricultural environmental subsidy in China. This part is also the innovation of this paper. The scope and standard of subsidies are clearly defined, and the responsibilities of government and agricultural producers are set up in the law on agricultural environmental subsidies. In order to ensure that agricultural environmental subsidies can be fully distributed to agricultural producers and to protect their rights, In order to achieve the legislative purpose of agricultural environmental subsidy, this paper also makes some other explanations in procedure.
