【摘要】：人本主義作為一種元話語(yǔ),不僅是一種價(jià)值觀,也是一種認(rèn)識(shí)論和方法論；人本主義之于國(guó)際法,可以提供一種新的價(jià)值尺度與分析框架。 現(xiàn)有國(guó)際法規(guī)則體系,以國(guó)家為權(quán)力與義務(wù)主體,“國(guó)本主義”主導(dǎo)其主流價(jià)值與制度設(shè)計(jì),“人本主義”較之“國(guó)本主義”作為低位階規(guī)范,尚未對(duì)國(guó)際法的價(jià)值導(dǎo)向與認(rèn)知方法產(chǎn)生實(shí)質(zhì)性影響。本文以“人本主義”為分析工具,對(duì)現(xiàn)有國(guó)際法規(guī)則進(jìn)行梳理,對(duì)人本化是否是國(guó)際法的應(yīng)然趨勢(shì)與必然歸宿?還是烏托邦的幻想?國(guó)際法現(xiàn)有的人本因素是否是對(duì)人本化的顯示與詮釋?人本化將在國(guó)際法規(guī)范中如何加以推進(jìn)?國(guó)際法的各部門規(guī)則將受到人本化的何種影響?等國(guó)際法人本化的問(wèn)題譜系進(jìn)行縱深性地研究,從而全面審視現(xiàn)有國(guó)際法規(guī)范的價(jià)值準(zhǔn)則與制度規(guī)范。
[Abstract]:As a kind of meta discourse, humanism is not only a kind of values, but also an epistemology and methodology. The existing system of rules of international law takes the state as the subject of power and obligation, and "nationalism" dominates its mainstream value and system design, and humanism is regarded as a low-ranking norm compared with "nationalism". It has not yet had a substantial impact on the value orientation and cognitive method of international law. This paper uses humanism as an analytical tool to sort out the existing rules of international law, and whether humanization is the necessary trend and inevitable destination of international law? Or utopian fantasy? Are the existing humanist factors in international law the manifestation and interpretation of humanization? How to promote humanization in the norms of international law? How will the sectoral rules of international law be affected by humanization? The humanization of international law is studied in depth, and the values and institutional norms of the existing norms of international law are comprehensively examined.
