論區(qū)際法律沖突下的公共秩序保留制度

【摘要】:公共秩序是一個籠統(tǒng)的概念,我國學術上公共秩序多用在國際私法的公共秩序保留制度中。在我國擁有四個不同的法域,各自行使著自己的立法權、司法權。其中存在著區(qū)際公共秩序保留制度。本文分四部分介紹了區(qū)際公共秩序保留制度,并且介紹了世界一些代表性的國家、地域的公共秩序保留制度,再研究了我國的情況,并且對我國的區(qū)際公共秩序保留制度提出了建議。 第一部分介紹了區(qū)際公共秩序保留制度。首先介紹了公共秩序制度的內容,各個分類。然后介紹了區(qū)際公共秩序保留制度的內容、本質及作用、以及確立該制度的意義,并與公共秩序保留制度在適用范圍等方面進行對比。 第二部分分別介紹了多法域國家美國、英國以及歐盟內的公共秩序保留制度的情況。首先,介紹了美國形成多法域的歷史、法律原因;并且介紹了美國公共秩序保留制度的發(fā)展,以及重要的判例法。再次,介紹了區(qū)際公共秩序保留制度在英國的各法域的情況,英國不區(qū)分區(qū)際公共秩序與國際公共秩序。并且說明學術與實踐對待區(qū)際公共秩序保留制度與國際公共秩序保留制度的不同。最后,,介紹了新興的歐盟組織的公共秩序保留制度,在這部分,介紹了公共秩序保留制度的法律來由;干預的方法和內容;公共政策與公共秩序的對比研究;說明歐盟國際私法公共政策存在的問題;歐盟與公共政策相關的判決。 第三部分介紹了我國區(qū)際公共秩序保留制度的研究意義,考慮我國各法域不同社會制度、不同法域、法律層級等說明我國區(qū)際公共秩序保留制度相比其他多法域國家的特點;之后分別詳細地介紹大陸、香港、澳門、臺灣立法、司法情況,舉出大量具體、詳細的區(qū)際公共秩序保留立法法條以及法院的判決。 第四部分根據(jù)上述介紹分析,對比各國做法,考慮本國特殊情況,對于我國區(qū)際公共秩序保留制度分立法與司法各自提出完善建議。立法上可以統(tǒng)一“公共秩序”用語,規(guī)定公共秩序保留制度內涵、統(tǒng)一用“客觀說”、規(guī)定排除違反公共秩序法律之后的法律適用等。司法上具體案件適用“客觀說”,不搞地方保護主義,不唯地方利益至上。 整篇論文對于區(qū)際私法公共秩序保留的系統(tǒng)介紹分析希望能對我國各法域之間的公共秩序保留制度做出一定的促進作用。
[Abstract]:Public order is a general concept. In our country, the academic public order is mostly used in the public order reservation system of private international law. In our country, there are four different jurisdictions, each exercising its own legislative power. Judicial power. Among them, there is an inter-regional public order reservation system. This paper introduces the inter-regional public order reservation system in four parts, and introduces the public order reservation system of some representative countries and regions in the world. The paper also studies the situation of our country, and puts forward some suggestions on the reservation system of interregional public order in our country. The first part introduces the reservation system of inter-regional public order. Firstly, it introduces the content and classification of the system of public order. Then it introduces the content, essence and function of the system of inter-regional public order reservation, as well as the significance of establishing the system. And compared with the public order reservation system in the scope of application and so on. The second part introduces the reservation system of public order in the United States, the United Kingdom and the European Union respectively. Firstly, it introduces the history and legal reasons of the formation of multi-jurisdiction in the United States. It also introduces the development of the public order reservation system in the United States, as well as the important case law. Thirdly, it introduces the situation of the inter-regional public order reservation system in various jurisdictions of the United Kingdom. The United Kingdom does not distinguish between interregional public order and international public order. It also shows the difference between academic and practical treatment of the reservation system of interregional public order and that of international public order. In this part, the author introduces the legal reasons of the public order reservation system, the methods and contents of intervention, the comparative study of public policy and public order. This paper explains the problems existing in the public policy of EU private international law and the judgments related to public policy in the EU. The third part introduces the significance of the research on the reservation system of the inter-regional public order in China, considering the different social systems, different jurisdictions and legal levels in different legal regions of our country to explain the characteristics of the reservation system of the inter-regional public order in our country compared with other multi-jurisdiction countries. After that, they introduced in detail the legislation and judicial situation of the mainland, Hong Kong, Macao, Taiwan, and cited a large number of specific, detailed interregional public order retention legislative law articles and court decisions. The 4th part, according to the above introduction and analysis, contrasts the practice of various countries, considers the special situation of our country, and puts forward the perfect suggestion to our country's inter-regional public order reservation system by legislation and judicature, which can unify the term "public order" in legislation. It stipulates the connotation of public order reservation system, unified use of "objective theory", and the application of law after excluding violation of public order law, etc. In judicature, specific cases apply "objective theory" and do not engage in local protectionism, and do not respect local interests first. The whole paper introduces the system of the reservation of public order of private law in the region and hopes to promote the reservation system of public order among different jurisdictions of our country.
