【摘要】：公海保護(hù)區(qū)作為國(guó)家管轄范圍之外海洋生物多樣性養(yǎng)護(hù)的有效措施,近年來(lái)得到廣泛的關(guān)注與發(fā)展。目前已經(jīng)有多個(gè)公海保護(hù)區(qū)的區(qū)域性實(shí)踐,在制度建設(shè)和管理實(shí)踐方面取得了不小的進(jìn)展。但是現(xiàn)有公海保護(hù)區(qū)制度也存在許多問(wèn)題,導(dǎo)致其接受范圍受到限制。公海保護(hù)區(qū)廣泛建立以后,勢(shì)必會(huì)對(duì)各國(guó)利用國(guó)際海底區(qū)域(以下簡(jiǎn)稱"區(qū)域")的海洋資源產(chǎn)生影響和限制。本文旨在對(duì)這兩種法律機(jī)制的沖突表現(xiàn)和沖突原因進(jìn)行深入分析,以探尋解決應(yīng)對(duì)之道,促進(jìn)公海保護(hù)區(qū)制度的發(fā)展,提高公海保護(hù)區(qū)的接受范圍。本文從法律沖突和法律對(duì)策的角度,通過(guò)查閱中英文文獻(xiàn)資料,利用比較分析、歸納分析等研究方法,對(duì)兩個(gè)制度之間的沖突之處進(jìn)行剖析,探究沖突產(chǎn)生的深層次原因,以尋求解決協(xié)調(diào)方法。本文共分成五個(gè)部分,第一部分對(duì)公海保護(hù)區(qū)和"區(qū)域"法律制度進(jìn)行介紹,包括公海保護(hù)區(qū)的范圍和實(shí)踐,以及"區(qū)域"礦產(chǎn)資源開(kāi)發(fā)制度及環(huán)境保護(hù)制度。第二部分對(duì)兩個(gè)法律制度之間的沖突進(jìn)行分析,包括"區(qū)域"礦產(chǎn)資源活動(dòng)導(dǎo)致的環(huán)境污染管轄權(quán)沖突、"區(qū)域"基因資源活動(dòng)管轄權(quán)沖突等四個(gè)內(nèi)容。對(duì)沖突表現(xiàn)分析之后,第三部分開(kāi)始探索沖突產(chǎn)生的法律原因,并在第四部分提出解決方案,包括建立全球性公海保護(hù)區(qū)法律制度,加強(qiáng)管理機(jī)關(guān)信息交流與合作等內(nèi)容。最后,在第五部分分析沖突對(duì)我國(guó)的影響以及應(yīng)對(duì)策略,為我國(guó)在海洋資源可持續(xù)利用方面提供建議,維護(hù)我國(guó)的海洋權(quán)益。
[Abstract]:As an effective measure for the conservation of marine biodiversity beyond areas of national jurisdiction, high seas protected areas have received extensive attention and development in recent years. Considerable progress has been made in institutional construction and management practices. However, there are also many problems in the existing high seas protected area system, resulting in restrictions on the scope of its acceptance. After the widespread establishment of the high seas protected areas, It is bound to have an impact on and limit the use by States of the marine resources of the international seabed area (hereinafter referred to as "the area"). The purpose of this paper is to conduct an in-depth analysis of the manifestations and causes of conflict between the two legal mechanisms in order to find solutions to the problem, To promote the development of the high seas protected area system and to increase the acceptance scope of the high seas protected area. From the angle of conflict of laws and legal countermeasures, this paper makes use of comparative analysis, inductive analysis and other research methods, through consulting Chinese and English literature, and making use of comparative analysis, inductive analysis, etc. This article is divided into five parts: the first part introduces the legal regime of the high seas protected area and the area. Including the scope and practice of protected areas on the high seas, as well as the regime for the exploitation of mineral resources in the area and the regime for the protection of the environment. Part two analyses the conflicts between the two legal regimes, It includes four parts: jurisdiction conflict of environmental pollution caused by mineral resources activities in the area and jurisdiction conflict of genetic resources activities in the area. After analyzing the conflict performance, the third part begins to explore the legal causes of the conflict. In part 4th, the author puts forward some solutions, including the establishment of a global legal system on high seas protected areas, and the strengthening of information exchange and cooperation among regulatory authorities. Finally, in part 5th, it analyzes the impact of the conflict on our country and its countermeasures. To provide suggestions for the sustainable use of marine resources in China, and to safeguard the marine rights and interests of our country.
