【摘要】：歐洲理事會的經(jīng)濟和社會權(quán)利的集體申訴制度是任擇的,自1998年建立以來富有成效地運轉(zhuǎn)著。在這一申訴機制中,歐洲社會權(quán)利委員會處于核心地位,其審查程序公平、公正。歐洲理事會部長委員會對歐洲社會權(quán)利委員的報告的審議是程序性的,因其最后決議或建議對被申訴締約國不具有法律約束力,導致效果的不均衡。申訴案件涉及的條款較為集中。這一制度是各締約國經(jīng)濟和社會權(quán)利國內(nèi)救濟機制在國際法上的延伸,是國際人權(quán)理論和實踐發(fā)展的結(jié)果,并將進一步推動經(jīng)濟和社會權(quán)利的國際救濟機制的發(fā)展。
[Abstract]:The Council of Europe's collective complaints system on economic and social rights is optional and has functioned productively since its establishment in 1998. In this complaints mechanism, the European Commission on Social Rights is at the centre of the system and its review procedure is fair, Impartiality. The consideration by the Committee of Ministers of the Council of Europe of the report of the European Committee of Social Rights is procedural, as its final resolutions or recommendations are not legally binding on the State party complained of, This system is an extension of the domestic remedies mechanism of the economic and social rights of States parties in international law and is the result of the development of international human rights theory and practice, And will further promote the economic and social rights of the international relief mechanism development.
