【摘要】：藥品試驗數(shù)據(jù)保護(hù)是在專利權(quán)之外政府為鼓勵藥品創(chuàng)新而提供的另一種知識產(chǎn)權(quán)保護(hù)形式。藥品試驗數(shù)據(jù)專屬權(quán)是指在一定期間內(nèi),賦予創(chuàng)新藥試驗數(shù)據(jù)所有人以其藥品試驗數(shù)據(jù)申請藥品上市的權(quán)利。在藥品試驗數(shù)據(jù)保護(hù)期內(nèi),禁止提出該創(chuàng)新藥的學(xué)名藥上市申請,以保障創(chuàng)新藥研發(fā)企業(yè)在此期間內(nèi)收回研發(fā)藥品的投資。通過分析《TRIPS協(xié)定》《北美自由貿(mào)易協(xié)定》《美國—中美洲自由貿(mào)易協(xié)定》中關(guān)于藥品試驗數(shù)據(jù)保護(hù)的規(guī)定,從公共健康的角度梳理了藥品試驗數(shù)據(jù)保護(hù)的例外限制及強(qiáng)制許可制度。在比較藥品試驗數(shù)據(jù)獨占保護(hù)和非獨占保護(hù)兩種模式的基礎(chǔ)上對我國藥品試驗數(shù)據(jù)保護(hù)制度的完善提出了建議。
[Abstract]:Drug test data protection is another form of intellectual property protection provided by the government to encourage drug innovation outside the patent right. The exclusive right to drug test data refers to the exclusive right to drug testing data for a certain period of time. The owner of the innovative drug test data shall be granted the right to apply for the listing of the drug on the basis of his drug test data. During the period of protection of the drug test data, it shall be prohibited to apply for the listing of the drug under the scientific name of the innovative drug, In order to ensure that innovative drug R & D enterprises recover their investment in R & D during this period. By analyzing the provisions of the North American Free Trade Agreement (NAFTA) on the protection of drug testing data in the United States-Central America Free Trade Agreement (NAFTA), From the perspective of public health, the exception limitation and compulsory licensing system of drug test data protection are combed. On the basis of comparing the two modes of exclusive protection and non-exclusive protection of drug test data, the data protection of drug test in China is given. Suggestions are put forward for the perfection of the system.
