【摘要】：我國已經(jīng)確定將在2017年啟動全國統(tǒng)一的碳排放權(quán)交易市場,建立完善的碳排放權(quán)交易的各項(xiàng)具體制度,同時制定完備的碳排放權(quán)交易法律制度為其提供法律層面的保障,使我國的碳排放權(quán)交易市場可以健康、有序運(yùn)行,盡快參與到國際碳定價中,搶占有利地位,展現(xiàn)出中國作為負(fù)責(zé)任的大國全力執(zhí)行和落實(shí)《巴黎協(xié)定》的堅(jiān)定信念。然而,對于交易中涉及到的交易環(huán)節(jié)和所涉及的各項(xiàng)問題離不開法律制度的規(guī)范。不能忽視的事實(shí)是,我國碳排放權(quán)交易的研究較歐盟、美國等發(fā)達(dá)國家起步較晚,當(dāng)然這既是劣勢也是優(yōu)勢。一方面,我國在應(yīng)對氣候變化和碳排放權(quán)交易方面的相關(guān)立法不完備,在啟動全國碳排放權(quán)交易市場的過程中難免要先進(jìn)行相關(guān)立法的填補(bǔ)。另一方面,我們可以借鑒早已率先建立碳排放權(quán)交易市場并且已成熟完善的歐盟、美國等國家的經(jīng)驗(yàn),還要借鑒與我國同為發(fā)展中國家的印度,在建立其本國的碳排放權(quán)交易法律制度方面的特色經(jīng)驗(yàn),取其精華,去其糟粕,同時結(jié)合我國的基本國情,形成可以指導(dǎo)我國建立統(tǒng)一的全國性碳排放權(quán)交易市場的相關(guān)法律制度。本文重點(diǎn)通過對有關(guān)國際上主要國家的先進(jìn)的碳排放權(quán)交易制度進(jìn)行闡述,借鑒歐盟、美國和印度現(xiàn)有碳排放權(quán)交易法律制度的有益經(jīng)驗(yàn),同時總結(jié)我國各省市碳排放權(quán)交易試點(diǎn)成立以來的發(fā)展經(jīng)驗(yàn),為我國建立統(tǒng)一的全國性碳排放權(quán)交易市場提供法律制度方面的建議。
[Abstract]:In 2017, China has decided to launch a unified carbon trading market in China, to establish a perfect specific system of carbon emissions trading, and to establish a complete legal system for carbon emissions trading to provide legal protection. To enable China's carbon emissions trading market to operate in a healthy and orderly manner, to participate in international carbon pricing as soon as possible, to occupy a favorable position, and to demonstrate China's firm belief in the full implementation and implementation of the Paris Agreement as a responsible big country. The trading links and problems involved in the transaction cannot be ignored without the norms of the legal system. The fact that the research on carbon emissions trading in our country started later than that in the European Union, the United States, and other developed countries can not be ignored. Of course, this is both a disadvantage and an advantage. On the one hand, China's legislation on dealing with climate change and carbon emissions trading is not complete. In the process of starting up the national carbon emissions trading market, it is inevitable to fill in the relevant legislation. On the other hand, we can learn from the experience of the European Union, the United States and other countries that have already taken the lead in establishing the carbon emissions trading market and are already mature. We should also draw lessons from the experience of India, which is a developing country with China, in establishing its own legal system for carbon emissions trading, take its essence and discard its dross, and at the same time combine the basic conditions of our country. Form the relevant legal system which can guide our country to establish a unified national carbon emission trading market. This paper mainly expounds the advanced carbon trading system of the major countries in the world, and draws lessons from the European Union. The beneficial experience of the existing legal system of carbon emissions trading in the United States and India, and the development experience of carbon trading in various provinces and cities of China since the establishment of the pilot program, To establish a unified national carbon emissions trading market in China to provide legal system recommendations.
