【摘要】：作為國(guó)際司法裁判進(jìn)程的"副產(chǎn)品",國(guó)際法上的"司法造法"問(wèn)題因?yàn)閲?guó)際爭(zhēng)端解決的"司法化"趨勢(shì)而日漸突出。在對(duì)國(guó)際法進(jìn)行解釋和適用的過(guò)程中,國(guó)際司法機(jī)構(gòu)不時(shí)突破正常的司法職能,事實(shí)上修改或創(chuàng)設(shè)規(guī)則,從而對(duì)國(guó)際法的發(fā)展產(chǎn)生了實(shí)質(zhì)性的影響。在"南海仲裁案"中,雖然國(guó)際仲裁庭在多個(gè)方面進(jìn)行了大尺度的"造法"工作,但囿于正當(dāng)性、公正性和政治化等方面的結(jié)構(gòu)性缺陷,這一"造法"活動(dòng)價(jià)值有限且有損國(guó)際法治。相關(guān)裁決不應(yīng)成為國(guó)際法上可資援引的"先例"。
[Abstract]:As a "by-product" of the process of international judicial adjudication, the problem of "judicial law making" in international law is increasingly prominent because of the trend of "judicialization" of international dispute settlement. In the process of interpretation and application of international law, From time to time, international judicial organs break through their normal judicial functions and, in fact, modify or create rules, thus having a substantial impact on the development of international law... in the South China Sea Arbitration case, Although the international arbitral tribunal has carried out large-scale "law-making" work in many aspects, it is constrained by structural defects in terms of legitimacy, impartiality and politicization. This "law-making" activity is of limited value and undermines the international rule of law. The relevant decision should not constitute a "precedent" that can be invoked in international law.
