【摘要】：在當(dāng)前國(guó)際貿(mào)易的制度安排中,知識(shí)產(chǎn)權(quán)執(zhí)法越來(lái)越受到關(guān)注,《反假冒貿(mào)易協(xié)定》便是這一問(wèn)題的最新實(shí)踐。可以預(yù)見(jiàn),《反假冒貿(mào)易協(xié)定》在民事措施、邊境措施、刑事措施、數(shù)字環(huán)境下的專(zhuān)門(mén)執(zhí)法措施等方面超《與貿(mào)易有關(guān)的知識(shí)產(chǎn)權(quán)協(xié)定》標(biāo)準(zhǔn)的執(zhí)法規(guī)則,將使我國(guó)在未來(lái)的知識(shí)產(chǎn)權(quán)談判中面臨更大的壓力,也可能給我國(guó)企業(yè)帶來(lái)消極影響。我國(guó)應(yīng)在世界貿(mào)易組織多邊體制中主張《反假冒貿(mào)易協(xié)定》違背《與貿(mào)易有關(guān)的知識(shí)產(chǎn)權(quán)協(xié)定》規(guī)則,并在談判等方面準(zhǔn)備好應(yīng)對(duì)策略。
[Abstract]:In the current institutional arrangements for international trade, the enforcement of intellectual property rights has received more and more attention. The Anti-counterfeiting Trade Agreement is the latest practice of this problem. It can be foreseen that the Anti-counterfeiting Trade Agreement is in civil, border, and criminal measures. Special enforcement measures in the digital environment, and other aspects, which exceed the standards of the Agreement on Trade-Related aspects of intellectual property Rights (trips), will make our country face greater pressure in the future intellectual property negotiations. China should advocate "Anti-counterfeit Trade Agreement" in the multilateral system of the World Trade Organization to violate the rules of the Agreement on Trade-Related aspects of intellectual property Rights (trips), and prepare for countermeasures in such aspects as negotiation.
