【摘要】：各國(guó)日益重視采用服務(wù)貿(mào)易措施應(yīng)對(duì)氣候變化,我國(guó)WTO服務(wù)承諾亦與氣候變化相關(guān)。因措施通常視成員是否承擔(dān)減排義務(wù)而給予不同待遇,容易違反非歧視原則,一般例外是判斷措施合法性的關(guān)鍵。一般例外適用于氣候變化時(shí)將面臨措施性質(zhì)認(rèn)定、必要性測(cè)試、發(fā)展中成員可否利用引言獲得特殊待遇等諸多難題。為確保一般例外適用的可預(yù)見性并妥善平衡貿(mào)易與氣候變化,需強(qiáng)化貿(mào)易與氣候變化的相互支持,解決一般例外法理的連貫性不足等缺陷,避免僵化解釋,力爭(zhēng)規(guī)則更新修改。
[Abstract]:Countries pay more and more attention to adopting service trade measures to deal with climate change, and China's WTO services commitment is also related to climate change. Because measures are usually treated differently depending on whether members undertake emission reduction obligations, it is easy to violate the principle of non-discrimination. The general exception is the key to judging the legality of the measure. When the general exception applies to climate change, it will face a determination of the nature of the measure, a necessity test, In order to ensure predictability of the application of general exceptions and a proper balance between trade and climate change, there is a need to strengthen the mutual support between trade and climate change, To solve the defects such as the lack of coherence of general exception, avoid rigid interpretation, and strive to update the rules.
