【摘要】：目前國際上雖然也有不少關(guān)于減少或消滅無國籍狀態(tài)的條約,各國國內(nèi)的國籍法也可以提供一點(diǎn)幫助。然而事實(shí)是,無國籍人的數(shù)量仍在每年上升,對(duì)其沒有有效的法律規(guī)制,生活狀態(tài)混亂,權(quán)利缺失狀況沒有改善。本文擬通過對(duì)無國籍人法律地位的描述,來闡明無國籍問題的急迫性與重要性,從而為如何規(guī)制無國籍人奠定基礎(chǔ),以及如何解決無國籍人權(quán)利缺失,生活艱難的問題,為國際人權(quán)的解決提供一點(diǎn)微薄的意見。全文主要分為五個(gè)部分。第一部分引言主要介紹文章的研究背景、研究意義、研究方法及研究的創(chuàng)新點(diǎn);第二部分從案例出發(fā)來介紹無國籍人及其生活現(xiàn)狀;第三部分闡述無國籍人在法律上的地位。首先分析無國籍人在國際條約及相關(guān)規(guī)定中的法律地位,然后闡述各個(gè)國家對(duì)無國籍人的法律規(guī)制,包括出入境,就業(yè),婚姻,教育等方面;第四部分闡述對(duì)無國籍人法律規(guī)制當(dāng)中產(chǎn)生的問題分析;第五部分是對(duì)完善無國籍人法律規(guī)制的若干建議。最后進(jìn)行總結(jié),得出我的結(jié)論以及對(duì)無國籍人問題解決的期望與祝愿。
[Abstract]:Although there are many international treaties on the reduction or elimination of statelessness, and national nationality laws can also provide some help. However, the fact is that the number of stateless persons is still increasing every year and there is no effective legal regulation on them. This paper intends to clarify the urgency and importance of statelessness by describing the legal status of stateless persons so as to lay a foundation for the regulation of stateless persons. And how to solve the problem of the lack of rights of stateless persons and the difficult life, and provide a little advice for the solution of international human rights. The paper is divided into five parts. The first part introduces the research background and significance of the article. The second part introduces the stateless people and their living conditions from the case. The third part expounds the legal status of stateless persons. First, it analyzes the legal status of stateless persons in international treaties and related provisions, and then expounds the legal regulation of stateless persons in various countries, including entry and exit, employment, marriage. Part 4th explains the problems arising in the legal regulation of stateless persons. Part 5th is a summary of some suggestions to improve the legal regulation of stateless persons. Draw my conclusion and hope for solving the problem of stateless person.
