【摘要】：隨著科學技術的發(fā)展,人類對地球的探索已經擴展到了海洋,帶來巨大經濟效益的同時也對生態(tài)環(huán)境造成了破壞。石油開采、漁業(yè)捕撈等現代活動對海洋自由的掠奪遠遠大于保護,對生物多樣性也是巨大的毀滅。如此下去,子孫后代將面臨物種滅絕的慘境,整個地球生態(tài)平衡也將被打破。為了更好的規(guī)制海洋秩序,《聯合國海洋法公約》于1982年開放簽署,但因公約中對國際海底區(qū)域制度的規(guī)定觸及發(fā)達國家的自身利益,許多傳統海洋強國拒絕加入該公約。為了達成一種共識,發(fā)展中國家也不斷妥協,在對國際海底區(qū)域制度進行了根本性修改之后,國際海洋法的體系才逐漸建立。作為最為權威的一部國際海洋法公約,《聯合國海洋法公約》涵蓋了所有的一切海洋活動,因此對國際海底區(qū)域的活動也須在公約的框架下進行討論,但公約也有不足的地方,即并未對生物資源的可持續(xù)利用做出詳細規(guī)定。為了彌補公約在國際海底區(qū)域生物資源保護方面的缺憾,《生物多樣性公約》提出了一系列有利于生物多樣性保護的制度及原則,是全球生物多樣性保護的一個重要里程碑,也是海洋生物多樣性保護的重要國際條約之一。作為第一部專門規(guī)定生物多樣性保護的國際性公約,其根本框架也應與《聯合國海洋法公約》法律框架一并討論,這對研究國際海底區(qū)域的生物多樣性保護是十分有必要的。
[Abstract]:With the development of science and technology , mankind ' s exploration of the earth has been extended to the oceans , bringing great economic benefits and destroying the ecological environment . As the most authoritative international convention on the law of the sea , the international convention on the law of the sea has been established . As the most authoritative international convention on the law of the sea , the international convention on the law of the sea has also been established . As the most authoritative international convention on the law of the sea , the fundamental framework of the Convention on the Law of the Sea should also be discussed in conjunction with the legal framework of the United Nations Convention on the Law of the Sea , which is necessary to study the conservation of biodiversity in the international seabed area .
