【摘要】：空間資產(chǎn)是《空間資產(chǎn)議定書》的適用對(duì)象，空間資產(chǎn)的明晰界定對(duì)議定書適用范圍的確定有著至關(guān)重要的作用。對(duì)空間資產(chǎn)定義問題的研究，目的在于理清空間資產(chǎn)定義爭(zhēng)議繁多和《空間資產(chǎn)議定書》進(jìn)程波折的關(guān)鍵所在，進(jìn)而推動(dòng)議定書法律實(shí)踐的順利進(jìn)行，對(duì)促進(jìn)國(guó)際私法、國(guó)際公法體系的進(jìn)一步完善和國(guó)際空間商業(yè)化的長(zhǎng)足發(fā)展有著突出的理論以及現(xiàn)實(shí)意義。 結(jié)合《空間資產(chǎn)議定書》制定歷程中所形成的詳實(shí)的文獻(xiàn)資料，采用歸納研究和比較分析的研究方法，首先通過對(duì)議定書制定背景、制定意義及起草歷程的介紹，分析了空間資產(chǎn)定義問題的背景和在《空間資產(chǎn)議定書》框架下研究空間資產(chǎn)定義問題的意義，認(rèn)為空間資產(chǎn)定義問題的剖析是探究《空間資產(chǎn)議定書》整體法律制度的必要前提，研究空間資產(chǎn)定義問題意義重大，為下文研究奠定了理論基礎(chǔ)。接下來，總結(jié)歸納了近十五年來空間資產(chǎn)定義問題的發(fā)展演變，并就“空間資產(chǎn)的范圍”、“術(shù)語的使用”、“零部件及制造過程中的資產(chǎn)”、“界定的標(biāo)準(zhǔn)和方式”等爭(zhēng)議焦點(diǎn)進(jìn)行了系統(tǒng)闡述，介紹了這些爭(zhēng)議焦點(diǎn)的具體表現(xiàn)和相關(guān)爭(zhēng)議方的利益考慮。在以上研究的基礎(chǔ)上，從立法目的和法的適用性等視角考量，批判性地提出了對(duì)空間資產(chǎn)定義中相關(guān)焦點(diǎn)問題、空間資產(chǎn)終結(jié)定義及與其相關(guān)的其它問題即“議定書與外空條約體系的關(guān)系”、“政府角色的定位”、“中國(guó)空間資產(chǎn)和空間商業(yè)化”的思考。 研究認(rèn)為，，空間資產(chǎn)的界定乃至議定書的制定和實(shí)施都要始終堅(jiān)持便利空間商業(yè)融資的原則；空間資產(chǎn)終結(jié)定義是相對(duì)理想的界定；各國(guó)政府應(yīng)找準(zhǔn)其在國(guó)際商業(yè)活動(dòng)中的角色；中國(guó)應(yīng)積極謀求與國(guó)際接軌，大力促進(jìn)空間商業(yè)化的發(fā)展。創(chuàng)新之處在于：是《空間資產(chǎn)議定書》成功制定之后對(duì)空間資產(chǎn)定義問題進(jìn)行的首次系統(tǒng)探討，更新和完善了國(guó)內(nèi)在該領(lǐng)域的研究，對(duì)中國(guó)空間商業(yè)化進(jìn)程和空間立法的發(fā)展有著一定的啟示作用。

The introduced specific expressions of the focus of controversy and disputes related party interests. On the basis of the above research, the consideration from the legislative purpose and the applicability of the proposed critical perspective, to focus on issues related to the definition of assets in space, space is defined and its related assets end "protocol and other issues the outer space treaty system", "localization" of the role of government, "China on space assets and space commercialization.
Research shows that the formulation and implementation of space assets and protocol should always adhere to the principle of convenient commercial financing space; space assets end is defined as defining relative ideal; governments should find its role in the international commercial activities; China should actively seek with international standards, vigorously promote the development of commercial space innovation. Lies in: To explore space assets is "successful after the development of protocol > space assets definition of systems for the first time, to update and improve the domestic research in this field, it has certain enlightenment to the development of China space commercialization and space legislation.
