【摘要】：隨著資本主義商品經(jīng)濟(jì)的發(fā)展,國(guó)際貿(mào)易的進(jìn)一步發(fā)展,經(jīng)濟(jì)全球化的進(jìn)一步加快,知識(shí)產(chǎn)權(quán)貿(mào)易在國(guó)際貿(mào)易中所占的比重日益增大,然而由于知識(shí)產(chǎn)權(quán)的地域性導(dǎo)致了各國(guó)對(duì)知識(shí)產(chǎn)權(quán)的保護(hù)水平不均衡。在這種矛盾的情況下,在世界主要發(fā)達(dá)國(guó)家倡議下,締結(jié)了《與貿(mào)易有關(guān)的知識(shí)產(chǎn)權(quán)協(xié)議》,即TRIPS協(xié)議,形成了知識(shí)產(chǎn)權(quán)國(guó)際保護(hù)體系。TRIPS協(xié)議下的知識(shí)產(chǎn)權(quán)國(guó)際保護(hù)的特點(diǎn)是范圍更廣,措施更嚴(yán),標(biāo)準(zhǔn)更高,爭(zhēng)端解決更有效,改變了知識(shí)產(chǎn)權(quán)的保護(hù)方式,確立了一系列新的制度與標(biāo)準(zhǔn)。但是,從知識(shí)產(chǎn)權(quán)國(guó)際保護(hù)的歷史背景來(lái)看,近代知識(shí)產(chǎn)權(quán)國(guó)際保護(hù)機(jī)制是在發(fā)達(dá)國(guó)家的主導(dǎo)下制定的,即使是最近的TRIPS協(xié)議也是如此,廣大落后的發(fā)展中國(guó)家只是被動(dòng)接受。這個(gè)代表著發(fā)達(dá)國(guó)家利益的知識(shí)產(chǎn)權(quán)國(guó)際保護(hù)制度,不可避免的存在著一些不足與缺陷。知識(shí)產(chǎn)權(quán)國(guó)際保護(hù)制度的高標(biāo)準(zhǔn)弱化了發(fā)展中國(guó)家的立法主權(quán),加大了經(jīng)濟(jì)發(fā)展的成本。對(duì)于此,我國(guó)要研究自己的對(duì)策,建立健全國(guó)內(nèi)知識(shí)產(chǎn)權(quán)保護(hù)制度,加強(qiáng)自己的知識(shí)創(chuàng)新能力。 本文通過(guò)考察這場(chǎng)由發(fā)達(dá)國(guó)家主導(dǎo)建立的知識(shí)產(chǎn)權(quán)國(guó)際保護(hù)制度產(chǎn)生與發(fā)展的歷史背景,探討了TRIPS協(xié)議下知識(shí)產(chǎn)權(quán)國(guó)際保護(hù)的內(nèi)容、功能、基本原則以及現(xiàn)階段知識(shí)產(chǎn)權(quán)國(guó)際保護(hù)面臨的問(wèn)題和挑戰(zhàn)。進(jìn)一步分析了中國(guó)知識(shí)產(chǎn)權(quán)的現(xiàn)狀和TRIPS協(xié)議下知識(shí)產(chǎn)權(quán)的國(guó)際保護(hù)對(duì)我國(guó)造成的影響,找出我國(guó)知識(shí)產(chǎn)權(quán)保護(hù)中存在的問(wèn)題,并提出我國(guó)知識(shí)產(chǎn)權(quán)保護(hù)的對(duì)策。 本文主要分為五個(gè)部分,第一部分介紹了此文的學(xué)術(shù)和實(shí)用意義,國(guó)內(nèi)外研究現(xiàn)狀等。第二部分詳細(xì)論述了TRIPS協(xié)議框架下知識(shí)產(chǎn)權(quán)國(guó)際保護(hù)的概念,產(chǎn)生與發(fā)展,基本原則,以及TRIPS協(xié)議對(duì)知識(shí)產(chǎn)權(quán)的國(guó)際保護(hù)體制的主要內(nèi)容和功能及面臨的問(wèn)題和挑戰(zhàn)。第三部分說(shuō)明了中國(guó)知識(shí)產(chǎn)權(quán)保護(hù)的現(xiàn)狀及存在的問(wèn)題。第四部分介紹了TRIPS協(xié)議下知識(shí)產(chǎn)權(quán)的國(guó)際保護(hù)對(duì)我國(guó)的影響。第五部分詳細(xì)提出了中國(guó)知識(shí)產(chǎn)權(quán)保護(hù)的應(yīng)對(duì)之策。
[Abstract]:With the development of capitalist commodity economy, the further development of international trade and the further acceleration of economic globalization, the proportion of intellectual property trade in international trade is increasing day by day. However, due to the regional nature of intellectual property rights, the level of protection of intellectual property rights in various countries is not balanced. Under this contradiction, the Agreement on Trade-Related aspects of intellectual property Rights (TRIPS Agreement) was concluded at the initiative of major developed countries in the world. The international protection of intellectual property rights under trips Agreement is characterized by a wider scope, stricter measures, higher standards, more effective dispute settlement, and a change in the way in which intellectual property rights are protected. A series of new systems and standards have been established. However, from the historical background of the international protection of intellectual property rights, the modern international protection mechanism of intellectual property rights was established under the leadership of developed countries, even the recent TRIPS agreement. The vast majority of backward developing countries only passively accept the international protection system of intellectual property rights, which represents the interests of developed countries. Inevitably, there are some shortcomings and defects. The high standards of the international protection system of intellectual property rights weaken the legislative sovereignty of developing countries and increase the cost of economic development. Establish and improve the domestic intellectual property protection system, strengthen their knowledge innovation ability. This paper discusses the content and function of the international protection of intellectual property under the TRIPS agreement by examining the historical background of the emergence and development of the international protection system of intellectual property, which is established by developed countries. The basic principles and the problems and challenges facing the international protection of intellectual property rights at the present stage. This paper further analyzes the current situation of intellectual property rights in China and the impact of the international protection of intellectual property rights under the TRIPS Agreement on our country. This paper finds out the problems existing in the protection of intellectual property rights in China, and puts forward the countermeasures for the protection of intellectual property rights in our country. This paper is divided into five parts, the first part introduces the academic and practical significance of this paper, the current research situation at home and abroad, etc. The second part discusses the concept, production and development, basic principles of international protection of intellectual property rights under the framework of TRIPS agreement in detail. As well as the main contents and functions of the international protection system of intellectual property rights under the TRIPS agreement, the problems and challenges faced by the international protection system of intellectual property rights. The third part describes the current situation and existing problems of intellectual property protection in China. Part 4th introduces the TRIPS protocol. Part 5th puts forward the countermeasures of China's intellectual property protection in detail.
