【摘要】：地理標(biāo)志是一種新興知識(shí)產(chǎn)權(quán),其保護(hù)歷史相比其他知識(shí)產(chǎn)權(quán)顯得較為短暫。正因?yàn)榈乩順?biāo)志保護(hù)時(shí)間不長、保護(hù)制度上的不成熟以及地理標(biāo)志本身蘊(yùn)藏著巨大的經(jīng)濟(jì)價(jià)值,使得地理標(biāo)志這一新興的知識(shí)產(chǎn)權(quán)成為國內(nèi)外眾多學(xué)者關(guān)注的焦點(diǎn)。特別是入世以來,雖然現(xiàn)實(shí)中侵犯地理標(biāo)志的現(xiàn)象層出不窮,國內(nèi)卻缺乏行之有效地保護(hù)機(jī)制,不能給地理標(biāo)志提供有力的保護(hù),國內(nèi)學(xué)者們加強(qiáng)地理標(biāo)志保護(hù)的呼聲日益增高。世界各國也逐步認(rèn)識(shí)到地理標(biāo)志保護(hù)的重要性,建立地理標(biāo)志國際保護(hù)制度的呼聲愈來愈高。 中國作為一個(gè)自然資源多樣、物產(chǎn)豐富的有著五千多年悠久歷史的大國,富饒的地理環(huán)境和深厚的文化底蘊(yùn)下孕育出數(shù)不勝數(shù)的地理標(biāo)志�，F(xiàn)階段,地理標(biāo)志背后蘊(yùn)藏的巨大經(jīng)濟(jì)價(jià)值使得地理標(biāo)志被濫用、被侵犯的事件時(shí)有發(fā)生所以加強(qiáng)地理標(biāo)志的保護(hù)力度,健全地理標(biāo)志保護(hù)機(jī)制以及完善監(jiān)督機(jī)制迫在眉睫。本文正是針對(duì)目前中國地理標(biāo)志保護(hù)存在的一系列問題,作了必要的梳理,并為中國建立和完善新的地理標(biāo)志保護(hù)制度提出筆者的淺見。
[Abstract]:Geographical indication is a new kind of intellectual property right, and its protection history is shorter than other intellectual property rights. It is precisely because the protection of geographical indication is not long, the protection system is immature and the geographical indication itself contains enormous economic value. This new intellectual property right of geographical indication has become the focus of attention of many scholars at home and abroad. Especially since China's entry into WTO, although the phenomenon of infringing on geographical indications appears endlessly in reality, there is a lack of effective protection mechanism in our country. Unable to provide strong protection for geographical indications, domestic scholars are increasingly calling for strengthening the protection of geographical indications. Countries all over the world have gradually realized the importance of the protection of geographical indications, and the calls for establishing an international system of protection of geographical indications are becoming more and more high. As a large country with a long history of more than 5,000 years and rich in natural resources and rich products, China has produced countless geographical indications due to its rich geographical environment and profound cultural heritage. The enormous economic value behind the geographical indications has led to the misuse of geographical indications and the occurrence of violations from time to time, so we should strengthen the protection of geographical indications. It is urgent to perfect the protection mechanism of geographical indications and to perfect the supervision mechanism. This paper makes a necessary combing of a series of problems existing in the protection of geographical indications in China. And for China to establish and improve the new system of geographical indications protection of the author's views.
