新能源補(bǔ)貼與WTO規(guī)則的關(guān)系研究

【摘要】:由于全球氣候變暖、資源枯竭、環(huán)境污染等全球性環(huán)境危機(jī)的出現(xiàn),以及2008年金融危機(jī)的刺激,新能源產(chǎn)業(yè)成為各國政府大力扶持的產(chǎn)業(yè)。各國對(duì)新能源的補(bǔ)貼力度也大大加強(qiáng),補(bǔ)貼形式也多種多樣。在WTO規(guī)則之下,部分補(bǔ)貼政策引起了爭端。新能源補(bǔ)貼對(duì)于環(huán)境保護(hù)的作用使其的存在具有一定的正當(dāng)性,但是同時(shí)需要對(duì)其進(jìn)行合理規(guī)制。 第一章介紹了各國有關(guān)新能源的立法政策與補(bǔ)貼概況,主要涉及美國、歐盟、南非、印度以及中國的政策,說明新能源補(bǔ)貼普遍存在,從而引出新能源補(bǔ)貼與WTO規(guī)則的關(guān)系,尤其是與《補(bǔ)貼與反補(bǔ)貼措施協(xié)定》(SCM)的關(guān)系。 第二章分析了新能源補(bǔ)貼與WTO所規(guī)制的補(bǔ)貼的關(guān)系。通過對(duì)新能源補(bǔ)貼與SCM下補(bǔ)貼的定義、類型的比較分析,得出新能源補(bǔ)貼與SCM規(guī)則存在沖突的可能性。 第三章從必要性和合理性角度論證新能源補(bǔ)貼的正當(dāng)性。由于新能源補(bǔ)貼有利于促進(jìn)環(huán)保產(chǎn)業(yè)的發(fā)展,因此符合國際環(huán)境法、WTO法關(guān)于環(huán)境保護(hù)的宗旨。此外,環(huán)境權(quán)概念的興起也為新能源補(bǔ)貼提供了正當(dāng)性依據(jù)。 第四章分析了具有正當(dāng)性的新能源補(bǔ)貼與WTO規(guī)則的協(xié)調(diào)關(guān)系。通過分析GATT第20條一般例外條款、SCM第8.2(c)條關(guān)于環(huán)境保護(hù)的補(bǔ)貼對(duì)新能源補(bǔ)貼的適用可能性,得出新能源補(bǔ)貼在WTO規(guī)則下的例外可能性。但是,如果新能源補(bǔ)貼超過了一定限度,成為變相的限制貿(mào)易的手段,則需要對(duì)其進(jìn)行合理的規(guī)制。
[Abstract]:Due to the emergence of global environmental crises such as global warming, resource depletion, environmental pollution, and the financial crisis in 2008, The new energy industry has become an industry supported by the governments of all countries. The subsidies to new energy have been greatly strengthened, and there are many forms of subsidies. Under the WTO rules, The effect of new energy subsidy on environmental protection makes its existence legitimate, but it needs to be regulated reasonably at the same time. The first chapter introduces the legislative policies and subsidies of various countries on new energy, including the policies of the United States, the European Union, South Africa, India and China, and explains the widespread existence of new energy subsidies, which leads to the relationship between new energy subsidies and WTO rules. In particular, the relationship with the Agreement on subsidies and countervailing measures (SCM). The second chapter analyzes the relationship between new energy subsidies and subsidies regulated by WTO. Through the definition and comparison of new energy subsidies and SCM subsidies, the possibility of conflict between new energy subsidies and SCM rules is obtained. Chapter III demonstrates the legitimacy of new energy subsidies from the point of view of necessity and rationality. Since new energy subsidies are conducive to the development of environmental protection industries, they are in line with the purpose of international environmental law and WTO law on environmental protection. The rise of the concept of environmental rights also provides a legitimate basis for new energy subsidies. Chapter 4th analyzes the harmonious relationship between legitimate new energy subsidies and WTO rules. By analyzing the possibility of applying environmental subsidies to new energy subsidies in Article 20 of GATT. The possibility of the exception of new energy subsidies under WTO rules is obtained. However, if the new energy subsidies exceed a certain limit and become a disguised means of restricting trade, it is necessary to regulate them reasonably.
