【摘要】：關(guān)于恐怖主義犯罪的概念問題,國際社會在對全面反恐公約草案的討論審議中有過激烈的沖突和對抗。目前,關(guān)于該問題的爭議實際上只剩下一個難題,即國家行為和民族解放運(yùn)動應(yīng)不應(yīng)當(dāng)被排除在恐怖主義犯罪概念之外。從恐怖主義犯罪實際情況看,不乏國家和民族解放運(yùn)動組織支持、資助恐怖組織及恐怖分子,甚至直接參與、實施恐怖活動的情況�？傊�,不論行為者是誰,在任何情況下針對平民的攻擊都應(yīng)視為恐怖主義罪行。
[Abstract]:With regard to the concept of terrorist crime, the international community has had a heated conflict and confrontation in its deliberations on the draft comprehensive convention on terrorism. That is, state acts and national liberation movements should not be excluded from the concept of terrorist crimes. Judging from the actual situation of terrorist crimes, there is no shortage of state and national liberation movement organizations that support the financing of terrorist organizations and terrorists. Even direct involvement in the commission of terrorist activities... in any event, an attack against a civilian population, regardless of the perpetrator, should be considered a terrorist offence.
