【摘要】：關(guān)于沖突規(guī)范的邏輯結(jié)構(gòu),我國(guó)國(guó)際私法學(xué)界通行的"范圍+系屬"論是錯(cuò)誤的,錯(cuò)誤的主要原因在于混淆了沖突規(guī)范條文和沖突規(guī)范本身。事實(shí)上,沖突規(guī)范在邏輯結(jié)構(gòu)上與其他法律規(guī)范是相同的,即由"假定+處理+法律后果"三要素構(gòu)成。
[Abstract]:With regard to the logical structure of conflict norms, the theory of "scope belonging" in the field of private international law in China is wrong, and the main reason for this error lies in the confusion between the articles of conflict norms and the conflict norms themselves. The conflict norm is the same as other legal norms in logic structure, that is, it is composed of three elements of "dealing with the legal consequences hypothetically".
