【摘要】：隨著人類的發(fā)展,科技的提高,海洋已經(jīng)越來越被人們所重視,海洋的地位也在不斷的攀升。曾經(jīng)有人說過21世紀(jì)是海洋的世紀(jì),這句話現(xiàn)在來看無疑是正確的。海洋經(jīng)濟總值在世界的經(jīng)濟總值中所占的比例不斷地加大,海洋產(chǎn)業(yè)的種類不斷地豐富,海洋,現(xiàn)在已經(jīng)越來越大的影響著這個世界。 1994年的《聯(lián)合國海洋法公約》拉開了一場海洋革命的帷幕,因為《公約》中規(guī)定了專屬經(jīng)濟區(qū)等制度,導(dǎo)致世界政治地理發(fā)生了變化。全球三分之一的海洋成為各國的海洋國土,沿海國家的海域管轄范圍大大的增加了,出現(xiàn)了廣泛的海洋開發(fā)熱潮,開發(fā)海洋、發(fā)展海洋經(jīng)濟成為世界各國發(fā)展經(jīng)濟的趨勢和重要戰(zhàn)略規(guī)劃。 在這種情況下,海洋法律成為日后的立法重點,相應(yīng)的海洋法律體系也成為重點研究的對象,在本文中,筆者第一章將闡述海洋的重要性,及其我們?yōu)槭裁匆芯亢Ｑ蠓审w系。在第二章中,筆者介紹海洋法律體系的概念,敘述海洋法律體系的功能,在第三章中敘述現(xiàn)階段我國海洋法律體系的現(xiàn)狀,第四章中筆者指出我國海洋法律體系的不足與缺失,在第五章中筆者最終通過針對我國海洋法律體系的不足來提出筆者自己的一點點想法與建議。
[Abstract]:With the development of human beings and the improvement of science and technology, the ocean has been paid more and more attention to, and the status of the ocean has been rising. Some people once said that 21th century is the century of the ocean. The total value of the marine economy as a proportion of the world's total economic value is increasing, and the marine industry is becoming more and more diverse and marine. Now it has become more and more influential in the world. In 1994 the United Nations Convention on the Law of the Sea opened the curtain of a maritime revolution because the Convention provides for the exclusive economic zone and other regimes. As a result, the world political geography has changed. 1/3 of the world's oceans have become the maritime territory of all countries, the maritime jurisdiction of coastal countries has greatly increased, and there has been a widespread wave of ocean development and development of the ocean. The development of marine economy has become a trend and an important strategic plan for the development of economy in various countries of the world. In this case, the marine law will become the focus of future legislation, the corresponding marine legal system has become the focus of research, in this paper, the author will explain the importance of the first chapter. In the second chapter, the author introduces the concept of marine legal system and describes the function of marine legal system. In the third chapter, the author describes the current situation of China's marine legal system. In Chapter 4th, the author points out the deficiencies and deficiencies of China's marine legal system. In chapter 5th, the author puts forward his own ideas and suggestions through the deficiency of China's marine legal system.
