【摘要】：國(guó)際體育仲裁院在索契冬奧會(huì)上設(shè)立的臨時(shí)仲裁庭共計(jì)仲裁5起案件,其中3件關(guān)于參賽資格,2件關(guān)于比賽結(jié)果。運(yùn)用文獻(xiàn)綜述和邏輯分析法,詳細(xì)介紹案件的發(fā)展過程。研究認(rèn)為,索契冬奧會(huì)仲裁實(shí)踐對(duì)不予審查原則的應(yīng)用強(qiáng)化了仲裁邏輯;陪審團(tuán)的仲裁思路逐漸轉(zhuǎn)向規(guī)避糾紛發(fā)生的方法。同時(shí),面對(duì)大量被駁回的無效申請(qǐng),如何提高仲裁質(zhì)量成為迫在眉睫的問題所在。
[Abstract]:The interim arbitration tribunal set up by the International Court of Sports Arbitration in Sochi Winter Olympic Games has arbitrated a total of five cases, of which 3 are about eligibility and 2 are about the result of the competition. Literature review and logical analysis are used. This paper introduces the development process of the case in detail. The study holds that the application of the principle of non-review in the arbitration practice of Sochi Winter Olympics strengthens the arbitration logic. At the same time, in the face of a large number of rejected invalid applications, how to improve the quality of arbitration becomes an urgent problem.
