【摘要】：交戰(zhàn)規(guī)則在現(xiàn)代軍事行動(dòng)中已經(jīng)得到普遍應(yīng)用,但因其自身的特殊性尚未廣為人知,理論研究也不盡成熟,國內(nèi)更是鮮有論述。此文通過分析交戰(zhàn)規(guī)則的五個(gè)主要特點(diǎn),說明對(duì)交戰(zhàn)規(guī)則定義的認(rèn)識(shí)。同時(shí)介紹了目前有關(guān)國際組織和國家的交戰(zhàn)規(guī)則制定情況,以期進(jìn)一步理解并明確制定交戰(zhàn)規(guī)則的基本依據(jù),即國家政策目標(biāo)、具體任務(wù)需要和相關(guān)法律規(guī)范。盡管不同類型軍事行動(dòng)中的交戰(zhàn)規(guī)則不盡相同,但一些基本內(nèi)容是所有交戰(zhàn)規(guī)則應(yīng)當(dāng)涵蓋和規(guī)范的,此文總結(jié)了其中主要的九個(gè)方面。實(shí)踐證明,任何交戰(zhàn)規(guī)則都是具體時(shí)空的產(chǎn)物,不可能是完美無缺的,其制定、執(zhí)行還存在諸多局限性和不盡人意之處。深入分析交戰(zhàn)規(guī)則的特點(diǎn)、內(nèi)容、依據(jù)及應(yīng)用情況,可以更好地適應(yīng)新軍事變革及多樣化軍事任務(wù)需要,進(jìn)一步提高我軍武裝沖突法的運(yùn)用技能。
[Abstract]:The rule of engagement has been widely applied in modern military operations. However, because of its particularity, it has not yet been widely known and theoretical research is not mature enough. By analyzing the five main features of the rules of engagement, this article illustrates the understanding of the definition of the rules of engagement. At the same time, it introduces the current situation about the establishment of engagement rules of international organizations and countries, with a view to further understand and clarify the basic basis for formulating the rules of engagement, that is, national policy objectives, specific task needs and relevant laws and regulations. Although the rules of engagement in different types of military operations are different, some basic contents are all rules of engagement that should be covered and regulated. This paper summarizes nine main points. Practice has proved that any rules of engagement are products of specific time and space, and cannot be perfect. There are still many limitations and imperfections in its formulation and implementation. An in-depth analysis of the characteristics, contents, basis and application of the rules of engagement can better meet the needs of new military reform and diversified military tasks, and further improve the application skills of our armed conflict law.
