【摘要】：近年來,各國網(wǎng)絡(luò)安全法律規(guī)制的不斷增多,已經(jīng)開始引發(fā)國家間的貿(mào)易爭端,2014年中國銀行業(yè)網(wǎng)絡(luò)安全和信息化法規(guī)就是一個突出的事例。各國有關(guān)網(wǎng)絡(luò)安全的規(guī)制,大量涉及對特定網(wǎng)絡(luò)安全產(chǎn)品和服務(wù)的市場準(zhǔn)入限制,從而有可能在國民待遇、補(bǔ)貼等方面產(chǎn)生與多邊貿(mào)易規(guī)則的沖突。同時(shí),作為"非傳統(tǒng)安全"事項(xiàng)的網(wǎng)絡(luò)安全問題也難以達(dá)到WTO安全例外的適用門檻。我國在積極加強(qiáng)網(wǎng)絡(luò)安全防范時(shí),應(yīng)當(dāng)最大限度地避免違反WTO規(guī)則,積極主導(dǎo)和參與網(wǎng)絡(luò)安全領(lǐng)域國際標(biāo)準(zhǔn)的制定,并推動WTO為網(wǎng)絡(luò)安全問題制定單獨(dú)的例外條款,對正當(dāng)、必要的網(wǎng)絡(luò)安全關(guān)切和"數(shù)字貿(mào)易壁壘"加以有效的區(qū)分。
[Abstract]:In recent years, the increasing number of laws and regulations on network security has begun to lead to trade disputes between countries. In 2014, China's banking network security and information regulation is a prominent example. The regulation of network security in many countries involves a large number of restrictions on market access for specific network security products and services, which may lead to conflicts with multilateral trade rules in terms of national treatment, subsidies and so on. At the same time, as a "non traditional security" issue of network security, it is difficult to reach the applicable threshold of WTO security exception. In our country, actively strengthen the network security, should avoid the maximum violation of WTO rules, actively leading and participating in the formulation of international standards in the field of network security, and promote the formulation of WTO exception clauses separately for the issue of network security, to effectively distinguish between legitimate and necessary network security concerns and the "digital trade barrier".
