我國物業(yè)小區(qū)自治管理機(jī)構(gòu)研究

【摘要】: 城市物業(yè)小區(qū)的數(shù)量逐漸增多,規(guī)模逐漸擴(kuò)大,物業(yè)管理成為熱點(diǎn)話題。上個(gè)世紀(jì)八十年代我國引進(jìn)了物業(yè)管理制度,經(jīng)過二十多年的發(fā)展,我國物業(yè)管理水平有所提高:業(yè)主自治概念逐漸為人們所接受;物業(yè)服務(wù)企業(yè)的服務(wù)水平也有所提高。但物業(yè)小區(qū)管理過程中仍然存在各種糾紛,特別是出現(xiàn)了不少暴力糾紛的事件,嚴(yán)重威脅到物業(yè)小區(qū)的穩(wěn)定和和諧。 追其根源,物業(yè)小區(qū)糾紛不斷、物業(yè)管理水平不高源于我國物業(yè)小區(qū)自治管理機(jī)構(gòu)的組織結(jié)構(gòu)和運(yùn)作存在問題。大多學(xué)者已經(jīng)認(rèn)識(shí)到我國現(xiàn)行法規(guī)定的物業(yè)小區(qū)自治管理機(jī)構(gòu)——業(yè)主大會(huì)和業(yè)主協(xié)會(huì)存在的各種問題,比如成立難、運(yùn)作困難、運(yùn)作效果不佳等,也提出了各種解決方法,比如完善監(jiān)督機(jī)制、賦予業(yè)主大會(huì)獨(dú)立的法人地位、賦予業(yè)主委員會(huì)民事訴訟主體地位或獨(dú)立的法人地位、增強(qiáng)居民委員會(huì)和街道辦事處在物業(yè)管理中的作用;等等。但這些方法在理論上都存在缺陷,在實(shí)踐中也不可行。 本文在分析了我國物業(yè)管理存在的基本問題后,詳細(xì)論述了我國現(xiàn)行法規(guī)定的物業(yè)小區(qū)自治管理機(jī)構(gòu)的現(xiàn)狀和存在的問題,借鑒了美國成熟的物業(yè)小區(qū)自治管理機(jī)構(gòu)制度和公司法的組織機(jī)構(gòu)框架,提出應(yīng)該在我國物業(yè)現(xiàn)行法上實(shí)現(xiàn)突破,采納“業(yè)主協(xié)會(huì)”的概念,業(yè)主協(xié)會(huì)擁有獨(dú)立的法人資格,其組織機(jī)構(gòu)包含業(yè)主大會(huì)和業(yè)主委員會(huì),理順業(yè)主協(xié)會(huì)與物業(yè)服務(wù)企業(yè)、開發(fā)商、居民委員會(huì)和街道辦事處的法律關(guān)系,從而解決我國物業(yè)管理中存在的各種問題,實(shí)現(xiàn)物業(yè)小區(qū)的良好自治管理,為建設(shè)和諧的社會(huì)小區(qū)和和諧的社會(huì)而努力。
[Abstract]:The number and scale of urban residential areas are increasing gradually, property management has become a hot topic. In the eighties of last century, China introduced the property management system. After more than 20 years of development, the level of property management in our country has been improved: the concept of owner autonomy has gradually been accepted by people, and the service level of property service enterprises has also been improved. However, there are still various disputes in the process of property estate management, especially many violent disputes, which seriously threaten the stability and harmony of the property district. In order to find out the root of the problem, the disputes in real estate district are constant, and the low level of property management originates from the problems in the organizational structure and operation of the autonomous management organization of the real estate district in our country. Most scholars have recognized the problems of the owners' Congress and owners' associations, such as the difficulties in setting up, operating difficulties and poor operational effects, as stipulated in the current law of our country, and have also put forward various solutions. For example, improve the supervision mechanism, endow the owners' Congress with the independent legal person status, give the owners' committee the status of the main body of civil litigation or independent legal person status, strengthen the role of the residents' committee and the street office in the property management; Wait However, these methods have defects in theory and are not feasible in practice. After analyzing the basic problems of the property management in our country, this paper discusses in detail the present situation and problems of the autonomous management organization of the real estate district, which is stipulated by the current law of our country. This paper draws lessons from the mature system of the self-governing institution of the real estate community and the organizational framework of the company law in the United States, and puts forward that we should make a breakthrough in the current law of property in our country, and adopt the concept of "owner's association", which has an independent legal personality. The organization includes the owners' Congress and the owners' committee, straightens out the legal relationship between the owners' association and the property service enterprises, developers, residents' committees and street offices, thus solving all kinds of problems existing in the property management in our country. To realize the good autonomous management of the real estate district and to build a harmonious social district and harmonious society.
