摘  要


隨著我國(guó)市場(chǎng)經(jīng)濟(jì)的不斷發(fā)展,勞務(wù)派遣這種新型用工方式的應(yīng)用越來越廣。勞務(wù)派遣制度的產(chǎn)生順應(yīng)了企業(yè)的發(fā)展需求,這種新型的用工方式滿足了用工單位的彈性的用人需求。勞務(wù)派遣制度的建立,從用工單位的角度看,節(jié)約了用工單位的人力資源成本,減少了用工單位的各種勞務(wù)糾紛。從整個(gè)社會(huì)的角度看,勞務(wù)派遣平衡了社會(huì)供需雙方的人力資源,促進(jìn)了人力資源的重新配置和合理流動(dòng)。從被派遣勞動(dòng)者的角度看,勞務(wù)派遣的工作大多是一些非技術(shù)性的勞動(dòng),為弱勢(shì)群體創(chuàng)造了大量公平擇業(yè)的機(jī)會(huì)。勞務(wù)派遣制度隨著我國(guó)市場(chǎng)經(jīng)濟(jì)的發(fā)展,其也在不斷的完善。我國(guó)在《勞動(dòng)合同法》、《勞動(dòng)合同法實(shí)施條例》等立法中對(duì)勞務(wù)派遣制度做了明確的規(guī)范,這進(jìn)一步促進(jìn)了勞務(wù)派遣制度的發(fā)展。雖然我國(guó)法律明確了與勞務(wù)派遣相關(guān)的內(nèi)容,但是由于我國(guó)勞務(wù)派遣制度起步晚,在各方面還不成熟,法律當(dāng)中的規(guī)范也存在一定的漏洞。法律中的一些條文僅是理論層面的指導(dǎo),與社會(huì)實(shí)踐還存在一定差距,,法律中的規(guī)范難以對(duì)現(xiàn)實(shí)的就業(yè)市場(chǎng)進(jìn)行有效的指導(dǎo)。勞務(wù)派遣市場(chǎng)存在的主要問題有:勞務(wù)派遣單位的資質(zhì)不夠,對(duì)勞務(wù)派遣的工作內(nèi)容及職責(zé)等方面缺乏明確的規(guī)范,對(duì)勞務(wù)派遣的三方主體的權(quán)利、責(zé)任及義務(wù)缺乏明確說明等。這些問題如果長(zhǎng)期得不到解決,長(zhǎng)期存在于我國(guó)社會(huì)中,會(huì)影響到用工市場(chǎng)的正常秩序,會(huì)對(duì)我國(guó)社會(huì)經(jīng)濟(jì)的健康發(fā)展造成一定影響。不斷完善法律法規(guī),建立起符合和保障各方利益的法律制度體系有利于維護(hù)各方當(dāng)事的人的合法權(quán)利,這也是我國(guó)推進(jìn)法制型社會(huì)建設(shè)的必然要求。
論文的第一部分闡述了勞務(wù)派遣的相關(guān)概念,包括勞務(wù)派遣的概念、特征及勞務(wù)派遣的分類、勞務(wù)派遣的法律關(guān)系、勞務(wù)派遣的現(xiàn)實(shí)價(jià)值,并分析了勞務(wù)派遣的利弊。論文第二部分介紹了我國(guó)勞務(wù)派遣制度實(shí)施的現(xiàn)狀,并分別從勞務(wù)派遣單位的市場(chǎng)準(zhǔn)入要求不高、缺乏對(duì)勞務(wù)派遣單位的監(jiān)督管理、勞務(wù)派遣市場(chǎng)不規(guī)范的用工形式、濫用派遣行為及區(qū)別性對(duì)待被派遣勞動(dòng)者等方面分析了目前我國(guó)勞務(wù)派遣制度存在的主要問題。論文第三部分介紹了有關(guān)國(guó)家勞務(wù)派遣制度的相關(guān)立法,及其借鑒價(jià)值。論文第四部分,針對(duì)我國(guó)勞務(wù)派遣制度存在的問題,分別從提高市場(chǎng)準(zhǔn)入門檻、完善勞務(wù)派遣監(jiān)管制度、明確勞務(wù)派遣適用范圍、規(guī)范用人單位與勞務(wù)派遣單位的責(zé)任、完善和加強(qiáng)同工同酬相關(guān)制度等方面提出相應(yīng)的改善建議及對(duì)策。論文第五部分總結(jié)全文的觀點(diǎn)及指出論文存在的不足。
本文通過對(duì)我國(guó)勞務(wù)派遣相關(guān)法律進(jìn)行了系統(tǒng)性的研究,充分借鑒了國(guó)外先進(jìn)的勞務(wù)派遣制度及理論研究成果,立足于我國(guó)當(dāng)下勞務(wù)派遣市場(chǎng)現(xiàn)狀,分析了我國(guó)勞務(wù)派遣制度中存在的問題并提出了相應(yīng)的解決措施。通過理論與實(shí)踐相結(jié)合的方法,使得理論更具有的說服力和指導(dǎo)價(jià)值,通過社會(huì)實(shí)踐反饋理論也更能檢驗(yàn)理論的不足,如此使得本文的研究更具有可推行的操作價(jià)值。其次,作者認(rèn)為我國(guó)勞務(wù)派遣制度的形成及發(fā)展是其特殊背景下的產(chǎn)物,其制度的完善同樣也要遵循我國(guó)的特殊國(guó)情及客觀規(guī)律。勞務(wù)派遣市場(chǎng)出現(xiàn)的混亂狀況很多時(shí)候并非是由于制度設(shè)計(jì)不夠合理、制度存在漏洞等原因,而是在實(shí)際執(zhí)行過程中缺少有效的監(jiān)管。因此完善勞務(wù)派遣法律制度的監(jiān)管配套措施是保證勞務(wù)派遣制度有效執(zhí)行的關(guān)鍵。
為科學(xué)、嚴(yán)謹(jǐn)論述課題有關(guān)內(nèi)容,本文采用了以下研究方法:一是系統(tǒng)分析法,對(duì)我國(guó)勞務(wù)派遣制度進(jìn)行全面的闡述,從勞務(wù)派遣的概念及特征,勞務(wù)派遣和相關(guān)概念的區(qū)別和分析,勞務(wù)派遣立法完善的必要性等進(jìn)行詳細(xì)闡釋和評(píng)析,同時(shí)梳理了我國(guó)勞務(wù)派遣立法實(shí)踐的現(xiàn)狀,在此基礎(chǔ)上思考我國(guó)該制度現(xiàn)存問題并提出自己的看法;二是文獻(xiàn)分析法,閱讀和參閱與課題相關(guān)的法學(xué)等理論專著、期刊文章及網(wǎng)絡(luò)文章,為論文寫作打牢理論基礎(chǔ)。廣泛收集前沿性資料,特別是典型的文獻(xiàn)資料,將有借鑒性的內(nèi)容充實(shí)到論文之中,為論文觀點(diǎn)作有力支撐;三是歸納分析法。本文以勞務(wù)派遣的理論問題及我國(guó)法律的現(xiàn)狀為切入和側(cè)重點(diǎn),通過對(duì)我國(guó)勞務(wù)派遣立法缺陷的分析探討,提出了完善立法的建議。

Abstract

With the continuous development of China's market economy, labor dispatch this new way of employment is applied more and more widely. Labor dispatching system conforms to the needs of the development of enterprises, this new way of employment to meet the employing units employing demand elasticity. Establishment of labor dispatch system, from the employer's point of view, save the unit labor cost of human resources, reducing the labor disputes labor units. From the social point of view, the labor dispatch balance social both supply and demand of human resources, to promote the re allocation of human resources and reasonable flow. From the perspective of labor dispatch employees, labor dispatching work mostly unskilled labor, created a large number of fair employment opportunities for vulnerable groups.
Labor dispatch system with the development of market economy in China, it also at continuously perfect. China in the "labor contract law", "labor contract law" Regulations for the implementation of the law on labor dispatch system to do a clear specification, which further promoted the development of labor dispatch system. Although Chinese law clearly to send relevant content and services, but because of China's labor dispatch system started late, in various aspects are not mature, the legal norms is a loophole. Some of the provisions of law is only theoretical guidance, but also has certain disparity with the social practice, the law in the specification difficult to effectively guide the practical employment market. The main problem existed in the labor market: the labor dispatch unit qualification is not enough, the lack of clear specification of the labor dispatching work and responsibilities, rights, responsibilities and obligations of the dispatched three parties such as the lack of clear. If these problems cannot be solved for a long time, has long existed in our society, will affect the normal order of the employment market, will cause a certain impact on the healthy development of social economy in china. Continuously improve laws and regulations, establish and safeguard the interests of all parties of the legal system is conducive to the maintenance of the parties' legal rights, which is China's inevitable requirement to promote the construction of the legal system society.
The thesis consists of five parts, as follows; The first chapter, the introduction part introduced the research background, purpose, meaning, method, content and research at home and abroad. The second chapter, describes the related concept of labor dispatch, including labor dispatch's concept, characteristics and classification of labor dispatch system, labor dispatch legal relations involved in labor dispatch, value and significance, and points out the advantages and disadvantages of labor dispatch. The third chapter, first briefly introduces the present situation of China's labor market, and from the labor dispatch market access requirements of the unit is not high, lack of supervision and management, dispatch unit of labor dispatch service market is not standard form of labor dispatch, abuse behavior and difference treat labor service dispatch staff and other aspects of the main problems at present Chinese labor dispatch market exists. The fourth chapter, in view of our country labor market problems, respectively, from raising the threshold for market access, improve the regulatory system, labor dispatch, labor dispatching scope clear specification by the employer and the labor dispatch unit responsibility, put forward the improvement suggestions and Countermeasures to improve and strengthen the relevant system of equal pay for equal work. The fifth chapter, summarizes the views and points out the shortcomings of the existing.
This paper systematically studies the China labor dispatching legal system and theory, referring to the foreign advanced research results, based on China's current labor market status, analysis of China's labor dispatch system in the existing problems and puts forward corresponding solving measures. By integrating theory with practice, makes the theory more persuasive and guiding value, through the practice of insufficient feedback testing theory, this makes this study more can promote the value of the operation. Secondly, the author believes that the formation and development of China's labor dispatch system is the product of its special background, perfect its system also should abide by China's special national conditions and objective law. Labor dispatch market confusion and many times is not due to the unreasonable design of the system, the system loopholes exist, but due to the lack of effective supervision in the actual implementation process. Regulatory measures to improve the legal system of dispatching is the key to ensure the effective implementation of the labor dispatch system.
The following methods were applied for scientifically rigorous elaboration on relevant topics. The first is system analysis. Labor dispatch system was elaborated comprehensively, including its concepts and characteristics, the discrimination between labor dispatch and other relevant concepts, current legislation and the necessity of improvement. The second is document analysis. As a basis of this study, jurisprudence monographs, journal articles and online articles were referenced.  Extensive collection of frontier information and typical literature were referenced as the grounds of argument. The third is the inductive analysis. In this study, theoretical issued related to the labor dispatch and the current legislation of China were raised. Legislative defects of labor dispatch were analyzed and respective recommendations were proposed.

引言

我國(guó)市場(chǎng)經(jīng)濟(jì)的不斷發(fā)展,市場(chǎng)經(jīng)濟(jì)的繁榮需要多樣化的企業(yè)經(jīng)營(yíng)方式,企業(yè)在創(chuàng)造經(jīng)濟(jì)效益方面可以選擇更加靈活的用工方式。勞務(wù)派遣這一用工方式隨之產(chǎn)生,為用工單位與勞動(dòng)者雙方搭建了溝通的渠道,提高了雙方互相選擇的成功率,滿足了企業(yè)臨時(shí)的或彈性的用工需求,降低了用工單位的勞工法律風(fēng)險(xiǎn),減少了用工單位的用人成本。2008年之前我國(guó)并沒有具體的法律規(guī)定勞務(wù)派遣這一內(nèi)容。隨著勞務(wù)派遣市場(chǎng)的形式,各種勞務(wù)派遣糾紛不斷,各種勞務(wù)派遣問題層出不窮,建立起相關(guān)的法律制度保障顯得尤為必要,F(xiàn)行的法律法規(guī)難以有效的解決這些現(xiàn)實(shí)問題,本文深入了解我國(guó)當(dāng)下的勞務(wù)派遣市場(chǎng),對(duì)隱藏在勞務(wù)派遣問題中的深層次原因及矛盾進(jìn)行深層次的分析,并試圖找出解決這些問題的辦法,并采取有效的解決對(duì)策更好地維護(hù)三方主體的合法權(quán)益。
