【摘要】：社區(qū)矯正作為與監(jiān)禁刑相對(duì)應(yīng)的刑罰執(zhí)行方式,是刑罰個(gè)別化、社會(huì)化、人道化的具體體現(xiàn),也是國(guó)家尊重和保障人權(quán)在刑罰領(lǐng)域的具體落實(shí)。因此世界各國(guó)對(duì)社區(qū)矯正的相關(guān)問(wèn)題都有深入的研究,不少國(guó)家還形成了獨(dú)具特色的社區(qū)矯正模式。本文試從社區(qū)矯正模式概念解讀、先進(jìn)經(jīng)驗(yàn)的分析、現(xiàn)狀的介紹等幾個(gè)方面對(duì)我國(guó)目前的社區(qū)矯正模式作簡(jiǎn)要的探討。全文共分為四章。第一章,社區(qū)矯正模式概述。該章闡述了社區(qū)矯正模式以及相關(guān)概念,介紹了國(guó)內(nèi)外學(xué)者對(duì)社區(qū)矯正的不同定義以及我國(guó)對(duì)社區(qū)矯正的定義,概括總結(jié)了社區(qū)矯正模式的涵義,列舉了社區(qū)矯正的特征；第二章,國(guó)外幾種主要社區(qū)矯正模式及啟示。該章通過(guò)對(duì)國(guó)外幾種較為成熟、先進(jìn)的社區(qū)矯正模式的介紹,總結(jié)出這幾種模式的主要特點(diǎn)及對(duì)我國(guó)社區(qū)矯正模式的啟示；第三章,我國(guó)主要社區(qū)矯正模式述要；本章通過(guò)介紹我國(guó)社區(qū)矯正試點(diǎn)工作的現(xiàn)狀,概括介紹我國(guó)目前幾個(gè)較為成熟的矯正模式的特點(diǎn)以及我國(guó)社區(qū)矯正模式的特點(diǎn)；第四章,我國(guó)社區(qū)矯正模式中存在的問(wèn)題及完善。本章主要闡述了我國(guó)社區(qū)矯正模式中現(xiàn)存的問(wèn)題,并從制度規(guī)范、隊(duì)伍建設(shè)、矯正方法等方面提出相關(guān)建議。
[Abstract]:Community correction, as a punishment execution method corresponding to imprisonment penalty, is a concrete embodiment of individualization, socialization and humanization of penalty, and is also the concrete implementation of the state's respect and protection of human rights in the field of punishment. Therefore, many countries have deeply studied the related problems of community correction, and many countries have formed a unique mode of community correction. In this paper, the concept of community correction model interpretation, the analysis of advanced experience, the introduction of the status quo and other aspects of the current community correction model in China to make a brief discussion. The full text is divided into four chapters. The first chapter is an overview of community correction model. This chapter describes the community correction model and related concepts, introduces the different definitions of community correction by domestic and foreign scholars and the definition of community correction in our country, summarizes the meaning of community correction model, lists the characteristics of community correction; The second chapter, several kinds of foreign main community correction pattern and enlightenment. Through the introduction of several mature and advanced community correction models abroad, this chapter summarizes the main characteristics of these models and their enlightenment to the community correction model in China. This chapter introduces the current situation of our country's community correction pilot work, summarizes the characteristics of several more mature correction models and the characteristics of our country's community correction model; The fourth chapter, our country community corrects the pattern existence question and the consummation. This chapter mainly expounds the existing problems in the mode of community correction in our country, and puts forward some relevant suggestions from the aspects of system standardization, team building, correction methods and so on.
