【摘要】：近幾年來(lái),我國(guó)的民事執(zhí)行案件逐年增多,“執(zhí)行難”、“執(zhí)行亂”現(xiàn)象日益突出,引起社會(huì)各界對(duì)執(zhí)行工作的廣泛關(guān)注。造成該現(xiàn)象的原因是多方面的,法院執(zhí)行缺乏強(qiáng)有力的外部監(jiān)督是其中較為重要的原因之一。社會(huì)各界對(duì)檢察機(jī)關(guān)參與民事執(zhí)行監(jiān)督給予了高度的關(guān)注,檢察機(jī)關(guān)在司法實(shí)踐中逐步開(kāi)展對(duì)民事執(zhí)行監(jiān)督的探索實(shí)踐,取得了良好的效果。本文從民事執(zhí)行檢察監(jiān)督的概念入手,比較分析了兩大法系國(guó)家的民事執(zhí)行檢察監(jiān)督立法以及對(duì)我國(guó)民事執(zhí)行檢察監(jiān)督制度的借鑒意義,在充分分析我國(guó)民事執(zhí)行工作中存在問(wèn)題的基礎(chǔ)上具體闡述了我國(guó)民事執(zhí)行檢察監(jiān)督的現(xiàn)狀,最后提出了構(gòu)建我國(guó)民事執(zhí)行檢察監(jiān)督制度的設(shè)想,以期能對(duì)我國(guó)民事執(zhí)行檢察監(jiān)督的完善有所幫助。
[Abstract]:In recent years, the civil execution cases in our country have been increasing year by year, and the phenomenon of "difficult execution" and "disorder of execution" has become increasingly prominent, which has aroused the widespread concern of all walks of life about the implementation work. There are many reasons for this phenomenon, and the lack of strong external supervision is one of the more important reasons. People from all walks of life pay great attention to the procuratorial organs' participation in the supervision of civil execution, and the procuratorial organs have gradually carried out the exploration and practice of civil execution supervision in judicial practice, and have achieved good results. Starting from the concept of civil execution procuratorial supervision, this paper compares and analyzes the legislation of civil execution procuratorial supervision in two legal system countries and its reference significance to our civil execution procuratorial supervision system. On the basis of fully analyzing the problems existing in the civil execution of our country, this paper expounds the present situation of the procuratorial supervision of civil execution in China, and finally puts forward the assumption of constructing the procuratorial supervision system of civil execution in our country. It is expected to be helpful to the improvement of procuratorial supervision of civil execution in China.
